I, (student or parent of student) in consideration of those services rendered, use of facilities and equipment, and instruction from and by Sweet Yield Studio, LLC hereby agree to the following:I wish to engage the services of Sweet Yield Studio, LLC its staff and its facilities for the purpose of dance and other instruction and training. I agree to abide by the rules and regulations of Sweet Yield Studio, LLC and may, from time to time, be published and amended. I will conduct myself in a reasonably prudent and safe manner at all times while participating in dance instruction or otherwise on facility property or grounds. I acknowledge and understand that dance instruction, and the use of facilities and equipment involves risk of harm, injury, loss, or damage to myself and to others.

I ACKNOWLEDGE AND FULLY UNDERSTAND THAT THERE ARE INHERENT RISKS INVOLVED IN PARTICIPATING IN THE ACTIVITY UPON THE PREMISES, WHICH MAY INVOLVE THE RISK OF INJURY, DISABILITY, OR OTHER HARM TO MYSELF OR TO OTHERS. I ACKNOWLEDGE THAT I AM VOLUNTARILY PARTICIPATING IN THE ACTIVITIES WITH KNOWLEDGE OF THE DANGER INVOLVED AND HEREBY AGREE TO ACCEPT AND ASSUME ANY AND ALL RISKS OF INJURY, OR DAMAGE, WHICH I, OR MY GUESTS OR INVITEES, MAY SUFFER, WHETHER CAUSED BY THE NEGLIGENCE OF SWEET YIELD STUDIO OR OTHERWISE.

Further I acknowledge that there may be other risks not known to me or not reasonably foreseeable at this time and assume such risks. I herby hold harmless and indemnify Sweet Yield Studio, LLC for any and all loss, harm, damages, or injuries to my person or property, including, but not limited to, legal damages, compensatory damages, punitive damages, costs and expenses of litigation and attorney’s fees.

I HAVE READ AND UNDERSTAND THE ABOVE WARNING, WAIVER, AND RELEASE. I AFFIRM THAT I AM AT LEAST 18 YEARS OF AGE, OR IF I AM UNDER 18 YEARS OF AGE, I HAVE OBTAINED THE REQUIRED CONSENT OF MY PARENTS/ GUARDIAN AS EVIDENCED BY THEIR SIGNATURE BELOW. FURTHERMORE, I AFFIRM THAT I HAVE THE REQUISITE AUTHORITY TO SIGN THIS AGREEMENT.

I grant permission to Sweet Yield Studio, LLC and its contractors and employees to use photographs of me, or the minor named below for use in studio advertisements of any print, digital, or social media presence including the Sweet Yield Studio website at www.sweetyieldstudio.com. Photos may appear with or without names in press releases and other print advertising. I waive any right to royalties or other compensation arising from the use of my photograph, and if signing on behalf of a minor named below, I waive all such rights of the minor named below. I grant Sweet Yield Studio, LLC the unrestricted right to use and publish photograph or video footage taken of me while participating in dance class, studio events or any performances.

This Agreement constitutes the sole and entire agreement of the Company and me with respect to the subject matter contained herein and supersedes all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to such subject matter.

If any term or provision of this Agreement is invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other term or provision of this Agreement or invalidate or render unenforceable such term or provision in any other jurisdiction. This Agreement is binding on and shall inure to the benefit of the Company and me and their respective successors and assigns. All matters arising out of or relating to this Agreement shall be governed by and construed in accordance with the internal laws of the State of Oklahoma without giving effect to any choice or conflict of law provision or rule (whether of the State of Oklahoma or any other jurisdiction). Any claim or cause of action arising under this Agreement may be brought only in the federal and state courts located in Oklahoma County, Oklahoma and I hereby consent to the exclusive jurisdiction of such courts.

BY SIGNING, I ACKNOWLEDGE THAT I HAVE READ AND UNDERSTOOD ALL OF THE TERMS OF THIS AGREEMENT AND THAT I AM VOLUNTARILY GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE THE COMPANY.
