Dog Health and Vaccinations:
The Client warrants that their dog is in good health and up-to-date on required vaccinations as recommended by their vet. Any infectious diseases or parasites must be made aware to the Trainer so that special precautions can be taken to avoid passing along any contagions.
Training Services:
The Trainer agrees to provide private lessons for the Client and their dog on a lesson-by-lesson basis, the goal being to teach the Client how to train and work with their Dog. The Trainer will make every reasonable effort to help the Client achieve training and behavior modification goals but makes no guarantee of the dog’s performance or behavior as a result of providing professional animal behavior consultation. The Client understands that he/she/they and members of the household must follow the Trainer’s instructions, work with the dog regularly as recommended, and consistently reinforce training being given to the dog. The Client understands that lessons are valid for up to 1 year (365 days) from purchase. Following that, the codes cannot be redeemed.
Cancellation Policy:
If the Client fails to give at least 12 hours cancellation notice, or is not present at time of scheduled appointment, session fees are still due. For a package deal, the session will still be counted as one session.
Refund Policy:
Private training sessions are refundable up to 48 hours before the first scheduled appointment. Private training appointments and packages are not refundable, in whole or in part, after this 48 hour window has passed. If the Client relocates to a distance outside of an hour travel time (via car, train, bus, or bike), they understand that any unused lessons can only be redeemed for virtual options. If the Trainer has made publicly aware for a minimum of 4 months that they are relocating, any unused in-person lessons can only be redeemed for virtual options after stated cut-off date. Private training sessions are valid for up to 1 year (365 days), after which the package code cannot be redeemed. For Alumni Monthly Check-in subscriptions, any unscheduled lessons will remain on the Client's account and can be used at a future date after they have cancelled their subscription, but are non-refundable.
Release of Liability and Indemnification:
The Client expressly acknowledges and understands that the Trainer’s services will be provided in an environment where certain hazards may exist, including, but not limited to, debris in the training area, other animals and their owners, training equipment, water, and other natural hazards. The Client expressly agrees to indemnify and hold harmless the Trainer and to pay all losses and damages suffered or incurred, and to defend and indemnify the Trainer from any claims, demands, lawsuits, losses, costs or expenses, including attorney fees, arising out of or in connection with the provision of the Trainer’s services to the Client and/or their dog. If the dog causes property damage, or bites or injures any animal or person (including but not limited to the Trainer), during or after the term of this Agreement, then the Client agrees to pay all resulting losses and damages suffered or incurred, and to defend and indemnify the Trainer from any resulting claims, demands, lawsuits, losses, costs or expenses, including attorney fees. If the dog is injured in a fight or in any other manner during or after the term of the Agreement, Client assumes the risk and agrees that the Trainer should not be held responsible for any resulting injuries, losses, damages, costs or expenses. At the Trainer's sole election, Trainer's duties hereunder shall terminate if (a) in the Trainer's sole judgment the dog is dangerous or vicious to the Trainer or any other person or animal, or interferes with the training of other dogs, or (b) the Client breaches any term or condition of this Agreement. Upon termination in accordance with the foregoing, the Trainer's duties shall terminate but all other provisions of this Agreement shall continue in full force and effect. This Agreement is binding upon the Client, spouse of the Client, and children of the Client. This Agreement supersedes all prior discussions, representations, warranties and agreements of the parties, and expresses the entire agreement between Client and Trainer regarding the matters described above. The parties confirm that, except for that which is specifically written in this Agreement, no promises, representations or oral understandings have been made with regard to the dog or anything else. Without limiting the generality of the foregoing, the Client acknowledges that the Trainer has not represented, promised, guaranteed or warranted that the dog will never bite, that the dog will not be dangerous or vicious in the future, that the dog will not exhibit other behavioral problems, or that the results of the training will last for any particular amount of time. This Agreement may be amended only by a written instrument signed by both the Client and the Trainer.
Photo Release:
The Client grants to the Trainer, and/or its representatives, the right to take photographs of the Client and/or the dog, and to copyright, use and publish the same in print and/or electronically. The Client agrees that the Trainer may use such photographs of the Client and/or the dog with or without their name and for any lawful purpose, including, for example, such purposes as publicity, illustration, advertising, and Web content.
Sick Days:
The Client agrees that they and the Trainer will be open about any communicable disease either the Trainer, the Client, or their dog are currently affected by. If continuing to attend an in-person lesson is mutually agreed upon, the Client and Trainer will practice safe procedures to reduce risk of infection, including but not limited to the wearing of masks, washing of hands, and keeping appropriate social distance during lessons. If the Client or anyone in their household exhibits symptoms of Covid-19 or any other communicable disease that is deemed more dangerous for sensitive groups, the Client will inform the Trainer and the lesson will be rescheduled until the Client is no longer showing symptoms.
