WAIVER OF LIABILITY : Broadway Kids Auditions, LLC (hereinafter, BKA), does not make false promises or representations. We are not agents, casting directors, or managers. We are an educational facility designed to provide audition coaching through acting, voice and dance training, classes, and workshops, as well as agent and casting director based training and forums. We do not and cannot guarantee bookings, signings, representation or work of any kind. I hereby release and hold harmless BKA, its owners, advisors, and all employees and agents of these parties from all liabilities, suits, claims, and/or demands of any nature, legal or financial, arising from the participation or observation of any activity sponsored by BKA. The student and guardian do voluntarily participate in any and all activities, and understand that certain risks are inherent to and from participation and involvement with BKA’s various formal and informal activities. BKA is not responsible for lost or stolen property at any time. Anyone found to be violating the rules, codes of conduct, or found to be disruptive to either another individual or group may be asked to leave the premises or off-site location at any time and may be refused re-entrance without any full or partial refund. BKA reserves the right to make decisions around weather and other acts of God. BKA practices healthy singing, dancing and physical activities. However, BKA is not responsible for injury of any kind during participation in our classes, private coaching sessions, master classes or workshops.

HIGH SPEED INTERNET CONNECTION FOR ALL ONLINE WORKSHOPS AND COACHING SESSIONS: High speed internet is needed for all online workshops and coaching sessions. BKA cannot be responsible for internet connections that do not work during our sessions and will not be able to refund tuition if a student cannot participate due to poor connection problems on their internet. By checking above, you are agreeing that you have working high speed internet for this workshop.

CANCELLATION POLICY: There is a 24 hour cancellation policy for all private coaching sessions. We reserve the right to hold payment for any session that is cancelled or re-scheduled after 24 hours prior to the scheduled session. There is a 48 hour cancellation policy on all studio spaces (based on individual studio policies). All sessions and packages expire one year from original date of purchase. By checking above, you are agreeing to our 24 hour cancellation policy, 48 hour studio cancellation and policy around session expiration dates.

All coaching sessions must be paid and scheduled prior to session. Should a session take place without payment, BKA reserves the right to automatically charge payment method on file no later than 24 hours after session takes place.

All coaching sessions, packages, workshops and credits expire one year from date of purchase.

All workshops and coaching sessions are for educational purposes only and are not and will not be considered auditions.

COVID-19 LIABILITY WAIVER FOR IN-PERSON COACHING AND WORKSHOPS:
Broadway Kids Auditions has put in place numerous preventative measures and enhanced cleaning protocols to reduce the likelihood of spreading COVID-19 at Broadway Kids Auditions events. However, we cannot guarantee that you or your child will not become infected with COVID-19. Further, attending Broadway Kids Auditions session(s) could increase your child’s risk of contracting COVID-19. By signing the agreement, I acknowledge the contagious nature of COVID-19 and voluntarily agree to the participation terms and conditions, as they may be modified by Broadway Kids Auditions in its sole and complete discretion, which have been implemented by Broadway Kids Auditions. I assume the risk that my child, myself, and other family members may be exposed to or infected by COVID-19 by attending any session(s) and activities with Broadway Kids Auditions, and that such exposure or infection may result in personal injury, illness, permanent disability or death. I understand that the risk of becoming exposed to or infected by COVID-19 at a Broadway Kids Auditions event may result from actions, omissions, or negligence of myself, my child and others, including, but not limited to, Broadway Kids Auditions employees, volunteers, other campers and their families. I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injuries to my child, myself, and other family members (including, but not limited to, personal injury, disability or death), illnesses, damages, losses, claims, liability, costs or expenses, of any kind (collectively, “Claims”), that I, my child and our family may experience or incur in connection with my child’s attendance at Broadway Kids Auditions programs. On my behalf, and on behalf of my child, I hereby release, covenant not to sue, discharge, and hold harmless Broadway Kids Auditions, its employees, volunteers, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions or negligence of Broadway Kids Auditions, its employees, volunteers, agents, and representatives, whether a COVID- 19 infection occurs before, during or after participation in a Broadway Kids Auditions program.
