By clicking on the box below you the (“Member”), desires to become a member of Muscles & Mommies Fitness/Train Your Genes Fitness (“Muscles & Mommies/TYG”) and agrees to the following terms and conditions as set out below.

PAR-Q: Member represents and warrants that all facts stated in the Physical Readiness Questionnaire (PAR-Q) submitted by Member are true and correct. The PAR-Q is incorporated herein by reference and made a part of this agreement.

PAYMENT OF FEES: All payments to Muscles & Mommies are final and can be made by one of the following options:
- Single Payment via Credit Card online, e-transfer or cash
- Monthly Payment via Credit Card online. Under this option, full payment of your first monthly due must accompany your registration. Payment to be made in full at time of registration/purchase.

Should Member select the monthly payment option, Member agrees to pay the then-current monthly fee, each month thereafter through automatic withdrawals from the credit card on file as entered by Member.

TERM: All participants of Muscles & Mommies/TYG are either month-to-month, package pricing or per session and payments are due in advance of each scheduled session.

No refunds or credits are given for any unused sessions. If Member is no longer able to use said sessions due to medical reasons a doctor note stating, Member is unable to continue must be presented to receive any refund. If this is the case the total number of sessions used will be deducted from Members package at FULL SESSION COST plus a $40.00CDN transaction fee. Member will be refunded the remaining amount within 30 days of refund approval.

If Member are unable to make it to their scheduled session Member must cancel said appointment within 24hrs otherwise the session is deemed to be forfeited. No refunds are issued on no show appointments, appointments not cancelled within 24hrs of appointment time or partially used sessions. MEMBERSHIP PACKAGES: Packages are billed monthly via the credit card Member submitted when purchasing the package online. Unused sessions as part of the membership packages will not be rolled over each month. If Member does not use all sessions each month they will be forfeited, no refunds are given for unused sessions. Packages can be upgraded or downgraded with 30 days written notice. Notice can be sent to erin@musclesandmommies.com

TRAINING: To take place in the Muscles & Mommies Studio at 7060 195A Street in Surrey, BC Canada unless otherwise agreed upon by Muscles & Mommies/TYG and Member. Travel Fees apply to any sessions outside of the Muscles & Mommies studio, refer to packages for travel fees.

RELEASE AND WAIVER OF LIABILITY: Member recognizes that there are hazards and risks associated with physical fitness training. These risks include but are not limited to, abnormal blood pressure, fainting, heart disorders and heart attach, dehydration, heat exhaustion, sprains muscle strain, blisters, stress fractures, shin splints, tendonitis, cartilage tears, bursitis, back pain and bruising of joints. Exercise beyond one’s physical limits and/or accidents involving exercise equipment may result in serious injury or even death. Member agrees to defend, indemnify and hold harmless Muscles & Mommies Fitness/TYG and Erin Osborne against any loss, damage or expense incurred by reason of any claim or liability and hold harmless Muscles & Mommies Fitness/TYG and Erin Osborne against any loss, damage or expense incurred by reason of any claim or liability based upon personal injury (including death) or property damage arising out of the negligent or intentional action of Member. Member further agrees to release Muscles & Mommies Fitness/TYG and Erin Osborne and it’s affiliates free and harmless from against the same.
- Under no circumstance shall member move exercise equipment or use the equipment in any manner not authorized by Muscles & Mommies Fitness/TYG.
- This membership is for Member, and Member only, it is not transferable to another individual.
- Member will not misuse the equipment.
- All members must be at least eighteen (18) years of age.
- Members shall conduct themselves in a quiet, well-mannered fashion so as not to cause any disturbance with may interfere with the use and enjoyment of the facility by any other member. Profanity or indecent language and/or behavior will not be tolerated. Any conduct deemed by Muscles & Mommies/TYG, in its sole discretion, to be offensive, potentially harmful, dangerous or abusive will not be tolerated, and shall be grounds for termination of Member’s membership by Muscles & Mommies/TYG.

PROHIBITED ACTIVITIES: Alcohol, drugs (including steroids), and smoking are prohibited within the facility. Member agrees not to use the facility of engage in any activity at Muscles & Mommies while under the influence of drugs, alcohol or medication that may impair Member’s ability to operate the equipment. No weapons of any kind are allowed.

DRESS POLICY: Muscles & Mommies requires that Member wears appropriate clothing and footwear in the facility. Appropriate clothing include gym attire (shorts, leggings, t-shirts, sweat shirts, etc.) and well structured athletic shoes.

MEMBERSHIP TYPE: Muscles & Mommies offers 3 membership types. Ensure you know the inclusions of your membership (available at www.musclesandmommies.com) and your renewal date. Knowing your membership is up to you as the member and not up to Muscles & Mommies/TYG to reiterate to you prior to purchase.

COUNTERPARTS: This agreement may be executed simultaneously in two or more counterparts, each of which shall be deemed an original, but all of which together shall constitute one and the same agreement.

HEADINGS: The headings in this agreement are inserted for convenience only and not constitute a part of this agreement.

BINDING EFFECT: This agreement shall be binding upon, inure to the benefit of, and be enforceable by the parties hereto and their respective successors and assigns.

ENTIRE AGREEMENT: This agreement, including the schedules, lists and other documents referred to in the agreement which form a part of this agreement, embody the entire agreement and understanding of the parties with respect to the subject matter contained in this agreement. There are in restriction, promises, warranties, covenants or undertakings, other than those set forth or referred to in this agreement. This agreement supersedes all prior agreements and understanding between the parties with respect to each subject matter.

GOVERNING LAW: This agreement, and all documents herein by reference, shall be governed by the laws of the Province of British Columbia.

FURTHER ASSURANCES: The parties agree to execute such further documents as may be necessary, proper or convenient, for the purpose of fully effectuating the terms and conditions of this agreement.

SUSPENSION AND TERMINATION: I understand that Muscles & Mommies/TYG may suspend or terminate my membership at any time, in its sole and absolute discretion, for non-payment of Membership fees or for violation of any of Muscles & Mommies/TYG policies and procedure, and that in so doing, Muscles & Mommies/TYG assumes no further liability to adhere to the terms of this agreement.

ACCEPTANCE AND TERMS: As a member, I understand that I am entitled to use the facility within the scope of the membership that I have selected, and that I am obligated to pay my dues and fees regardless of whether I use the facility. I agree to promptly update Muscles & Mommies/TYG of any change in my contact information (including address, telephone number and/or email address) or change in credit card information.

I CERTIFY THAT I HAVE READ THE FOREGOING MEMBERSHIP AGREEMENT, AND THAT BY CLICKING BELOW, I ACKNOWLEDGE THAT I UNDERSTAND AND AGREE TO BE BOUND BY ALL OF THE TERMS AND CONDITIONS HEREOF. I FURTHER ACKNOWLEDGE THAT BY CLICKING BELOW CONSTITUTES A FULLY EXECUTED MEMBERSHIP AGREEMENT. I ACKNOWLEDGE THAT I CAN REQUEST A COPY OF THESE TERMS AND CONDITIONS AT ANY TIME FOR INFORMATION PURPOSES.
