GENERAL STATEMENT OF PROGRAM OBJECTIVES & PROCEDURES
I understand that this physical fitness program includes exercises to build the cardiorespiratory system (heart and lungs), the musculoskeletal system (muscle endurance and strength, and flexibility), and to improve body composition (decrease of body fat in individuals needing to lose fat, with an increase in weight of muscle and bone).
Exercise may include aerobic activities (treadmill, walking, running, bicycling, rowing, and other aerobic activities), calisthenic and/or plyometric exercises, and weight lifting to improve muscular strength and endurance and flexibility exercises to improve joint range of motion.
DESCRIPTION OF POTENTIAL BENEFITS
I understand that a program of regular exercise for the heart, lungs, muscles and joints, has many benefits associated with it. These may include a decrease in body fat, improvement in blood fats and blood pressure, improvement in physiological function, and decrease in heart disease. I also acknowledge that results are not guaranteed and will vary depending on a variety of factors, including my own level of personal commitment to myself and to these training sessions.
I have read the foregoing information and understand it. Any questions that may have occurred to me have been answered to my satisfaction.
DESCRIPTION OF POTENTIAL RISKS & LIABILITY WAIVER
I understand that the reaction of the heart, lung, and blood vessel system to exercise cannot always be predicted with accuracy. I know there is a risk of certain abnormal changes occurring during or following exercise which may include abnormalities of blood pressure or heart attacks. Use of the weight lifting equipment, and engaging in heavy body calisthenics may lead to musculoskeletal strains, pain and injury if adequate warm-up, gradual progression, and safety procedures are not followed.
I understand that “People’s Athletic Club Inc.” (seller) & “Benjamin Foster” (personal trainer) shall not be liable for any damages arising from personal injuries sustained by Client (buyer) while and during the personal training program. I, the “Client” (buyer) using the exercising equipment during the personal training program does so at his/her own risk. I, the “Client” (buyer) assumes full responsibility for any injuries or damages which may occur.
I hereby fully and forever release and discharge “ People’s Athletic Club Inc.” (seller), and agents its assigns from all claims, demands, damages, rights of action, present and future therein.
I understand and warrant, release and agree that I am in good physical condition and that I have no disability, impairment or ailment preventing me from engaging in active or passive exercise that will be detrimental to heart, safety, or comfort, or physical condition if I engage or participate (other than those items fully discussed on health history form).
I state that I have had a recent physical checkup and have my personal physician's permission to engage in aerobic and/or anaerobic conditioning.
PAYMENT
I acknowledge and agree that this Agreement is not transferable or assignable. I acknowledge that payment is required for blocks of sessions in advance of actual training sessions. I agree to pay in advance for training sessions. I understand this money is not refundable. I understand this contract and the terms it presents is for the purchase of sessions and any other purchase of services in the future. I acknowledge that this specific contract, release of liability, consent, and agreement is continuously valid indefinitely. No refund will be granted for sessions that have not been completed. I understand that "People’s Athletic Club Inc.” (seller) & “Benjamin Foster” (personal trainer) have the right and the authority to terminate the program at any time, with no refund, if I do not follow the program or fail to conduct myself in an appropriate manner.
CANCELLATION & LATENESS
I acknowledge that appointment times are reserved and that cancellations must be made 24 hours in advance. Cancellations must be made by emailing: ben@peoplesathleticclub.com or by calling/texting 925-997-6783. I understand that I will not receive a refund for missed appointments. I understand that if I no-show or cancel in less than 24 hours notice, I will be charged in full. It is my responsibility to attend my personal training appointments when they are scheduled.
I understand that appointments will begin and end promptly as scheduled. I acknowledge that any delays to the start of a scheduled appointment will not be a cause of extended provided service beyond the remainder of the scheduled time. I will not expect or ask my trainer to run overtime. I understand that if I am 30 minutes late my session will be canceled and I will be charged for that session. I acknowledge that a delay to a scheduled session cannot change the session status to anything else except a whole session. I understand that there are no half sessions because of any delay.
