Welcome and congratulations on beginning your personal training program! We are delighted you chose us as a part of your commitment to health and fitness. With the help of your personal trainer, you will improve your ability to accomplish your training goals faster, safer, and with maximum benefits. The details of these training sessions can be used for a lifetime.
In order to maximize progress, it is important to follow program guidelines during supervised and (if applicable) unsupervised training days. Remember, exercise and healthy eating are EQUALLY important!
The following information will provide you with important program policies. Before getting started, please read and sign this form to acknowledge that you have read and understand the following information.
Personal Training Information and Policies
(“Client”) and Trainer. In consideration of the mutual promises exchanged herein and other good and valuable consideration, the parties agree as follows:
1.
Commitment:
By purchasing Sessions, Client is making a commitment to his/her health. Clients should follow the program and instructions of Trainer to the best of their ability to maximize their results and better achieve their goals. Remember, the ultimate results are up to the Client: Trainer will show Client how to work his muscles correctly and encourage him/her to go to his/her safe limit, but Client is the only one who can make sure he/she works out consistently, eats properly, gets plenty of sleep, and lives a healthy lifestyle. Fitness Assessment and Orientation is provided you will be charged a customary $85 fee for the initial assessment.
Specifics: Trainer and Client shall agree upon the time, program type, content, and location of personal training sessions (“Sessions”) at the rate set forth in this agreement.
2.
Length of Sessions:
Sessions will last approximately thirty (30) or forty-five(45) minutes depending on which program the client chooses. Trainer may opt to vary the length of sessions at his discretion.
3.
Online programs:
Client will receive one (30) minute session each week of the program via, video conference, phone, or email. Client will receive up to, two free general meal plans each month of program. Customized meal plans and extra coaching sessions are an additional cost. For payment of online training programs, refer to paragraph 7 of this PT Agreement.
4.
Nutrition Plans:
General nutritional counseling is included with all programs. General nutrition programs gives client access to all general meal plans and general nutritional counseling from the trainer. Client is able to receive customized nutritional counseling and meal plans for an additional charge.
5.
Punctuality:
Client shall be attired as discussed below and ready to train at the time specified in paragraph 2. Failure to be prepared to train may result in a shortened workout or possible cancellation of the Session under paragraph eight (8) below if Client is more than fifteen (15) minutes late. If Client anticipates running late, he/she should contact Trainer as soon as possible.
6.
Attire:
Client must wear comfortable workout attire, including, but not limited to, clean t-shirts, shorts, tights, sweats, and/or tracksuits. Athletic shoes must be supportive and functional. Workout gloves are optional. Please do not hesitate to ask Trainer for advice on what type of clothing and shoes is appropriate.
7.
Stopping Exercises:
Client may refuse or stop any exercise for any reason. It is Client’s responsibility to notify Trainer of any discomfort or pain arising from or during exercise, as well as, any and all other known limitations Client has or experiences so that Trainer may accommodate Client and substitute another exercise to work that particular muscle group.
8.
Payment:
Payment may be made in advance of Sessions in one lump sum or may be financed through equal monthly, bi- weekly, or weekly payments over the course of the term plan chosen at sign up. Should Client opt for monthly payments, he/she will be required to set up an automatic recurring payments. If a client does not want automated billing, he/she will be required to pay for their selected program in full. Paymenst due must be completed and cleared for all Sessions before any new or renewal contract may be signed. Trainer accepts cash, PayPal, credit card, debit card, or check only. It is the CLIENT’S RESPONSIBILITY to pay his/her bill, even in the event he/she does not receive an invoice. If Client’s payment declines, Trainer will suspend Sessions and erase any upcoming appointments until Client’s outstanding invoice is in made current.
*ALL RECURRING TRANSACTIONS WILL INCUR A 3.3% PROCESSING FEE AUTOMATICALLY ADDED TO EACH PAYMENT.
9.
Cancellation of Individual Sessions:
Twelve (12) hour cancellation notice via the scheduling application, or by phone call, text or email in the event the scheduling application is rendered non-functional; is required for rescheduling or cancelling any and all Sessions. Any and all cancellations with less than Twelve (12) hours notice will result in forfeiture of the Session without refund. If Trainer must cancel a Session, he will do so, via the scheduling application, or by phone call, text or email in the event the SETMORE is non-functional, with at least Twelve (12) hours notice or Client will receive a complimentary Session for his/her inconvenience. This complimentary Session will be added to the client’s total session count.
10.
Cancellation and Refund of All Sessions:
Client may cancel this contract within three (3) business days after the day this contract was signed for a full refund of any and all monies paid under this contract.
11.
Early termination of PT agreement.
If the client needs to cancel program early he/she is required to pay
1 1/2
months payment as an early cancellation fee. Once paid client will forfeit any accrued sessions, and all future recurring payments will be cancelled immediately. Compliance will keep the client in good standing in the event he/she would like to sign up in the future for training or nutrition programs. If the client fails to pay cancellation fee he/she could be denied services in the future and account balance could be turned over to arbitration.
12.
Session Expiration:
Client must complete all payments in order to use their total sessions. If you have any unused sessions after your last payment you have three (3) months after last payment to use those session. All sessions from the initial term must be used within one-hundred and twenty (120) days after last recurring payment has been captured, on the 121st day all unused sessions will be forfeited. The Client may request an extension which is subject to trainer’s approval.
13.
Relocation:
Should Client relocate his/her residence more than twenty-five (25) miles outside Trainer’s service area, Vinings, Georgia, Client may cancel this contract and shall be liable for only a cancellation fee of 100% of the monthly payment.
14.
Death or Disability:
Should Client become unable to use or receive services under this contract due to death or disability, Client, or Client’s estate as the case may be, shall be liable only for that portion of the charges allocable to the time prior to death or the onset of disability. .
15.
Cancellations in Writing:
Notice of cancellation must be made in writing and delivered to Trainer by certified or registered mail to Trainer at 2477 Cedar Canyon Rd. S.E. or delivered in person for any and all cancellations of all Sessions or all remaining sessions subject to the requirements of paragraphs nine (9) to eleven (11) above. All refunds (if applicable) will be made to the customer or his estate within thirty (30) days of receipt of the cancellation notice.
16.
Option to Renew:
After the initial term the client has the right to renew the agreement. By renewing a contract, Client acknowledges and agrees that Trainer acted professionally in all prior sessions.
17.
WAIVER AND INDEMNITY:
In consideration of services or property provided, I, for myself, my heirs, personal representatives and assigns, do hereby release, waive, discharge and covenant not to sue TriSet Fitness LLC and their respective board members, trustees, faculty, instructors, officers, agents, advisors, employees, affiliates, members, volunteers, staff, heirs, assigns, and representatives, (collectively, the “Releassees”) from any and all claims including, not by way of limitation, any claims arising from negligence of Releassees or any of them resulting in personal injury, accidents or illnesses (including death) and/or property loss arising from or relating in any way to participation in the Activity, the use of facilities in connection with the Activity, and/or travel before, during or after the Activity. I agree to indemnify and hold harmless Releasees from any and all claims, actions, suits, procedures, costs, expenses, damages and liabilities, including attorneys fees, and to reimburse Releasees for any such expense incurred in connection with or as a result of (1)(a) Participant’s participation in the Activity or (b) travel associated with the Activity or (2) arising in connection with or as a result of any attempt by anyone, including, not by way of limitation, Participation or anyone claiming on Participant’s behalf, to avoid the terms of this document which I freely sign. I have read this document in its entirety, fully understand its terms, and understand that I am giving up substantial rights – including my right to sue. I know, understand and appreciate these and other risks that are inherent in the Activity. I expressly agree and assert that participation in the Activity is voluntary and I knowingly assume all such risks and elect to proceed with the participation despite all the risks. I acknowledge that I am signing this document freely and voluntarily and intend, by my signature, the complete and unconditional release of all liability to the greatest extent allowed by law.
“Having such knowledge, I do hereby release TriSet Fitness LLC and employees of all liability related to injuries or accidents to myself which may occur as a result of participation in the Personal Training Program. I hereby assume all risks connected therewith and consent to participate in the Personal Training Program.”
