Liability Waiver

Because physical exercise can be strenuous and subject to risk of serious injury, Jakub Jursza urges you to obtain a physical examination from a doctor before beginning any exercise or training program. You agree that by participating in these physical exercise sessions or personal training activities, you do so entirely at your own risk. This includes, without limitation, (a) your use of all amenities and equipment in the facility and any off-site location and your participation in any activity, class, program, personal training or instruction, (b) the sudden and unforeseen malfunctioning of any equipment (c) our instruction, training, supervision, or dietary recommendations. You agree that you are voluntarily participating in these activities and use of these facilities and premises and assume all risks of injury. You expressly agree to release and discharge Jakub Jursza, from all claims or causes of action. This waiver and release of liability includes, without limitation, all injuries to you which may occur, regardless of negligence.

If any portion of this release from liability shall be deemed by a Court of competent jurisdiction to be invalid, then the remainder of this release from liability shall remain in full force and effect and the offending provision or provisions severed here from.

You acknowledge that you have carefully read this waiver and release and fully understand that it is a release of liability. You agree to voluntarily give up any right that you may otherwise have to bring a legal action against Jakub Jursza for negligence, or any other personal injury or property damage or loss action.

Photographs and Video Consent, Waiver, Indemnity and Release

Photographs, Videos and Recordings

I hereby grant permission to Jakub Jursza and its representatives to take photographs or videos of me and to make recordings of my voice at the event location.

I further grant to the producers and their representatives the right to reproduce, use, exhibit, display, broadcast and distribute and create derivative works of these images and recordings in any media now known or later Developed. I acknowledge that Jakub Jursza owns all rights to the images and recordings.

Waiver, Indemnity and Release

I hereby waive any right to inspect or approve the use of the images or recordings or of any written copy. I further waive all moral rights. I also waive any right to royalties or other compensation arising from or related to the use of the images, recordings, or materials. I hereby release, defend, indemnify and hold harmless the producers from and against any claims, damages or liability arising from or related to the use of the images, recordings or materials, including but not limited to claims of defamation, invasion of privacy, or rights of publicity or copyright infringement, or any misuse, distortion, blurring, alteration, optical illusion or use incomposite form that may occur or be produced in taking, processing, reduction or production of the finished product, its publication or distribution. I am 18 years of age or older and I am competent to contract in my own name. I have read this document before signing below, and I fully understand the contents, meaning and impact of this consent, waiver, indemnity and release. This consent, waiver, indemnity and release is binding on me, my heirs, executors, administrators and assigns.

Personal Training Terms and Conditions (applicable to private sessions and remote coaching)

1. Personal training sessions that are not rescheduled or cancelled 24 hours in advance will result in forfeiture of the session and a loss of the financial investment at the rate of one session.
2. Clients arriving late will receive the remaining scheduled session time, unless other arrangements have
been previously made with the trainer.
3. All the sessions must be used within the time that is stated in the chosen training package. Unused sessions at the end of the month do not roll over into the next month. Up to 2 sessions can be rolled over into the next month in certain emergency situations (subject to discussion - this is not guaranteed and will be only considered in special unforeseen conditions)
4. No personal training refunds will be issued for any reason, including but not limited to relocation, illness, and unused session
5. All sessions/training packages need to be paid at least 24 hours in advance before the first session.
6. One month's notice needs to be given before cancellation of a monthly subscription unless different arrangements have been made.
7. By subscribing to this coaching package, you are agreeing to commit to 3/6 monthly payments as stated above. After this period you will be billed monthly the same amount, but if you wish to stop your training you can opt-out with 1-month notice.***

***Only applies to coaching packages with 3 or 6-month commitment
