Coaching Agreement

SESSION TERMS & SCHEDULING
Per your contract, you may schedule the number of sessions based on your package terms per month/year. Sessions may not be carried forward beyond the terms of your package and must be booked within the length of your contract. Use it or Lose it. If purchasing an individual coaching package with a specific number of sessions, you will have up to 365 days to use them unless specifically stated in the product selection.
IMPORTANT NOTICE REGARDING COACHING SESSIONS
Coaching Sessions will be held via zoom. You may ask to record your session unless you ask for them to be recorded by your coach. You will get the most out of your coaching relationship if you show up ready to be coached by completely the pre-call form included in your calendar reminder.
* All calls will be held via Zoom; however, if issues arise with logging in please call me directly at 573-382-3258. Client will contact me at the time of our calls.
* To utilize your coaching to the fullest extent, make sure to call your coach promptly at the designated session time.
* If you call in late for your session, your session will still conclude at the original session completion time and will count as a completed session towards your plan.
* When participating in a coaching call, ensure you are doing it from an environment in which you will be able to totally concentrate and focus (free from interruptions).
* It is also important to have privacy so that you do not have to worry about anyone overhearing your conversation). It is imperative you say whatever you need to say. Coaching is not therapy and we will not be doing any therapy as part of the coaching program. We define therapy as dwelling with the past. Our focus in your coaching is on getting results in both the present and in the future.
Notice for Membership Group Clients ONLY
If you are unable to make a group call, you may either submit your coaching topics up to 1 hour in advance and the sessions are recorded and saved to your Kajabi Library.
If your package includes 1:1 coaching, you must book monthly sessions each month of the membership or you will lose them
COACHING SESSION CANCELLATION POLICY
The company has a 24-hour cancellation policy, which is based on Central Standard Time. Much like a doctor’s office, if you cancel or reschedule the appointment more than 24 hours in advance, everything proceeds as normal. If you need to reschedule less than 24-hours in advance, or worse case, you completely forget a call, the call will be considered a completed session and will be counted towards your coaching plan. If you choose to reschedule, you may be assessed a $50 reschedule fee.
CANCELLATION POLICY
You have up to 7 days to cancel your coaching package once you've paid (Lump sum or monthly payment received) assuming no sessions have been used in your package.
Membership Clients ONLY must submit cancellation requests by 15th of the month in order for cancellation to take effect the following month. If you do not submit cancellation request, your membership will auto renew and be billed to the card on file. Once cancellation request received, your membership will cease on the renewal date (date payment scheduled to be paid). NOTE: if you pay the monthly membership, you will be enrolled for a full year. You may cancel at anytime, but will have to wait a full year before re-entering the membership group.
PERSONAL RESPONSIBILITY
The Client acknowledges that the Client takes full responsibility for the Client’s life and well-being, as well as the lives and well-being of the Client’s family and children (where applicable), and all decisions made during and after this program. The Client releases the Coach from any and all liability, damages, causes of action, allegations, suits, sums of money, claims and demands whatsoever, in law or equity, which the Client ever had, now has or will have in the future against the Coach, arising from the Client’s past or future participation in, or otherwise with respect to, the Program, unless arising from the gross negligence of the Coach.
CONFIDENTIALITY
The Coach will keep the Client’s information private and will not share the Client’s information to any third party unless compelled to by law. ARBITRATION, CHOICE OF LAW, AND LIMITED REMEDIES In the event that there ever arises a dispute between Coach and Client with respect to the services provided pursuant to this agreement or otherwise pertaining to the relationship between the parties, the parties agree to submit to binding arbitration before the American Arbitration Association (Commercial Arbitration and Mediation Center for the Americas Mediation and Arbitration Rules). Any judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. Such arbitration shall be conducted by a single arbitrator. The sole remedy that can be awarded to the Client in the event that an award is granted in arbitration is refund of the Program Fee. Without limiting the generality of the foregoing, no award of consequential or other damages, unless specifically set forth herein, may be granted to the Client. This agreement shall be construed according to the laws of the State of Minnesota. In the event that any provision of this Agreement is deemed unenforceable, the remaining portions of the Agreement shall be severed and remain in full force. If the terms of this Agreement are acceptable, please sign the acceptance below. By doing so, the Client acknowledges that: (1) he/she has received a copy of this letter agreement; (2) he/she has had an opportunity to discuss the contents with the Coach and, if desired, to have it reviewed by an attorney; and (3) the client understands, accepts and agrees to abide by the terms hereof.
