Tetlow Music (Tuition) - General terms and conditions

Please read the applicable terms & conditions thoroughly before proceeding with your booking.

For lessons delivered at a School location please do not schedule a lesson via the online platform, a tutor will be in touch to arrange your lessons.

Whereby it is agreed
1. This Agreement shall continue until terminated by either Party giving to the other not less than 4 weeks notice in writing.
2. The Teacher may from time to time review the agreed rate for tuition. The Teacher shall give the Student/Guardian not less than 4 weeks’ written notice of any increase in rates.
Cancellation policy
1. The Guardian, or (if over 18) Student, has a legal right to cancel this Agreement and receive a refund under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations (2013) during the ‘cooling off period’ which starts from the date of this Agreement and ends 14 days later. To cancel the Agreement, the Student/Guardian should let the Teacher know by email that he/she has decided to cancel. The Teacher will confirm receipt of this email and arrange a refund for lessons not received. Reimbursement will be made using the same means of payment for the initial transaction, unless agreed otherwise.
2. The Guardian/Student (if over 18) hereby requests immediate commencement of the Lessons as booked into our online scheduler and acknowledges that he/she will not be entitled to a refund for any Lessons which have begun during the cooling-off period. Furthermore the Guardian/Student (if over 18) acknowledges that if your subscription includes any bonuses or gifts, your refund will deduct the value of goods that were delivered to you.
General terms specific for School tuition delivery
1. Tetlow Music cannot take responsibility for undelivered lessons when a tutor is available or has already arrived at a designated setting. This will apply in the following circumstances:
2. In the event that the session/lesson is cancelled by the school/service user without adequate notice
3. A pupil does not attend their lesson/s regardless of reason
4. Schools will liaise directly with the tutor to ensure delivery of the 33 sessions and provide enough opportunity to enable delivery of all 33 sessions. If the 33 sessions cannot be carried out in the year (due to a tutor absence, then these weeks will be refunded).
Finance specific for School tuition delivery
1. Tetlow Music will collect payments via the Acuity scheduling tool, details of the frequency and amount are stated at the top of this page, if the customer has signed up before the Autumn term. If sign up occurs at any other point in the year, payments will be spread across the remainder of the academic year and monthly payments will be adjusted accordingly.
2. The successful checkout procedure must be completed before any lessons or paid services can commence.
3. In the event of any difficulties with finance or payment Tetlow Music staff will be happy to liaise with guardians at the earliest opportunity.
4. If payment is not made, the tutor will not be able to deliver the lesson and will suspend or withdraw their services.
General
1. The Guardian/Student (if over 18), is responsible for ensuring that the relevant party is available for the arranged lesson as confirmed by email. Delays or interruptions (for which either the Guardian or Student is responsible) encroaching into this time will be considered as time provided.
2. For our private studio customers, if a student is unable to attend the lesson please use the portal on the studio calendar and cancel the lesson online. Use the online calendar to reschedule to another time. All lessons must be rescheduled 24 hours in advance, no refund or adjustments will be made for lessons not rescheduled 24 hours in advance.
3. If no notice to discontinue lessons has been served as above and the Student fails to attend an arranged lesson according to the Schedule provided by the Teacher (or as subsequently confirmed by email between the Teacher and Guardian/Student (if over 18)), fees for that lesson remain payable and no refund of any fees paid in advance will be given.
4. Should a lesson be missed by the Teacher for whatever reason, the Teacher will either provide a replacement lesson at an agreed time or issue a credit note.
5. Extra lessons may be scheduled at any other time by mutual agreement and at a cost agreed between the Guardian/Student (if over 18) and Teacher.
6. The Guardian and Student undertake not to make unlawful photocopies of music.
7. Examination entries, festivals, competitions or similar activities or events, will only be entered if the Guardian (in consultation with the Student) or student (if over 18) and Teacher agree. Any entry fees will be paid for by the Guardian/student (if over 18). (See note 1 below)
8. The Guardian/Student (if over 18) is responsible for informing the Teacher of any medical, health, or other such condition(s) which may affect the learning experience and interaction.
9. The Guardian/Student (if over 18) and Teacher agree to comply with all applicable laws,statutes,regulations including in relation to confidentiality, privacy, and GDPR.
10. Neither party shall be liable to the other party for any breach by the other of any of the terms and conditions herein occasioned by pandemic, any act of God, war, revolution, riot, civil disturbance, strike, lock-out, flood, fire or other cause not reasonably within the control of such party
Space and Equipment
1. The Teacher is not responsible for the loan of any equipment (e.g.,instruments,computers,etc.) or materials(e.g.,sheetmusic) unless agreed in advance.
2. Materials supplied electronically by the Teacher remain the Intellectual Property of the Teacher.
3. The Teacher is not liable for any technical faults, failures or damages of equipment used at the Guardian’s/Student’s premises or elsewhere for the purposes of receiving teaching and will not be required to make up any lost teaching time caused by such faults, failures or damages.
4. The Guardian/Student (if over 18) is responsible for the insurance of the Student’s instrument and all equipment used by the Student.
Space and equipment for online lessons
1. The Guardian/Student (if over 18) is responsible for providing suitable space and appropriate technology to enable online learning to be provided as advised by the Teacher.
2. The Teacher is not responsible for the loan of any equipment (e.g., instruments, cameras, computers, etc.) or materials (e.g., sheet music) unless agreed in advance.
3. The Guardian/Student (if over 18) is responsible for ensuring that the online teaching platform recommended by the Teacher is installed and ready for use prior to the commencement of lessons. All technical issues should be referred to the software/platform provider.
4. Materials supplied electronically by the Teacher remain the Intellectual Property of the Teacher.
5. The Teacher is not liable for any technical faults (e.g., insufficient or unreliable broadband to support audio and video, poor sound quality, computer hardware and software problems, etc.), failures of or damage of equipment used at the Guardian’s/ Student’s premises or elsewhere for the purposes of receiving online teaching and will not be required to make up any lost teaching time caused by such faults, failures or damage. Moving equipment in order to enhance the quality of video/audio is done at the Guardian’s/Student’s risk.
6. The Guardian is responsible for the insurance of the Student’s instrument and all equipment used by the Student for online teaching.
Safeguarding
1. Lessons must not be recorded by either party unless there is a prior agreement for this. If recordings are made, they must not be shared with third parties or uploaded to social media (this includes videos and photographs).
2. For students under the age of 18, all communications regarding missed or cancelled lessons must be between the Guardian and Teacher. Under no circumstances should the Student contact the Teacher directly or vice versa.
3. For Students over the age of 18, all communications regarding missed or cancelled lessons must be between the Student and Teacher direct.
4. For the purposes of confidentiality and privacy, all communications between the Guardian/Student (if over 18) and Teacher should be via email. Communication by telephone should only take place where necessary due to urgency, e.g., unavoidable last-minute cancellations.
5. Any defamatory, offensive or illegal material aired online and/or via social media by the Student or Guardian, or inappropriate behaviour by the Student or Guardian, will result in the immediate termination of lessons. What constitutes such behaviour will be determined in the reasonable opinion of the Teacher. In this instance, the Teacher reserves the right to withdraw entirely from this Agreement with immediate effect. Fees paid will not be refunded.
6. The Guardian may, if they wish, be present during the lesson if agreement is given by the Teacher.
7. The Teacher has a current DBS certificate.
Safeguarding for online lessons (students under 18)
1. The online teaching platform must not be used by the parties for any other purpose than teaching, e.g., sharing photos or general messaging.
2. Where possible the Guardian should assist the Student in limiting their profile within the online teaching app,using settings and preferences to maximise privacy. The Teacher will commit to doing the same.
3. All communications regarding missed or cancelled lessons must be between the Guardian and Teacher. Under no circumstances should the Student contact the Teacher directly.
4. Both the Teacher and Student must dress appropriately for the online lesson.
5. Both Teacher and Student should present against a neat and tidy background when using video.
Safeguarding for online lessons (Adults)
1. The online teaching platform must not be used by the parties for any other purpose than teaching, e.g., sharing photos or general messaging.
2. Where possible the Student should limit their profile within the online teaching app, using settings and preferences to maximise privacy. The Teacher will commit to doing the same.
3. The Teacher agrees to comply with the MU’s safeguarding advice in relation to online teaching. Current advice is available on the MU’s website.

Note 1: It is important to note that whilst a Teacher will use his or her best endeavours to ensure the Student makes satis-factory progress, this cannot be guaranteed. Careful regular practice as advised by the Teacher is a prerequisite of success on any musical instrument or in any musical endeavour.

Medical Emergencies - for Students under 18 only

I agree that, in the event of a medical emergency, the Teacher is authorised to seek professional medical care.

I am aware that the NHS advises the following:

a Young people aged 16 or over are entitled to consent to their own treatment. This can be overruled in exceptional circumstances.
b Children under the age of 16 can consent to their own treatment if they are believed to have enough intelligence, compe-tence and understanding to fully appreciate what’s involved in their treatment (known as being Gillick competent).

I understand the Teacher is not a first aider and I consent to the Teacher treating the Student in whatever way, mentally and physically that they consider common sense and in the best interests of the Student.

I also consent to the Student being treated by any medical professionals called by the Teacher.
