TERMS AND CONDITIONS

The parties in this contract refer to: "StrongerNow" as the seller, and the "Client" as the buyer.
The parties agree to the following terms and conditions:
The client agrees to the payment of all amounts stated in the cart upon purchase of service or subscription.
Personal/Virtual/Group Training Sessions: Training Sessions may include, but are not limited to, the following activities: testing of physical fitness; exercise; aerobics and aerobic conditioning; cardiovascular training; weight lifting and training; and stretching. Training session duration is subject to be longer or shorter than the 60 minute time frame based on the discretion of the Coach.
Personal/Virtual/Group Training Packages or Subscriptions and the Payments: The Client is paying for the sessions at the price displayed on the online checkout cart attached to this contract. Clients must pay according to the scheduled payment plan outlined in the online store and cart, unless otherwise agreed upon or stated in this contract. All Personal/Virtual/Group Training Sessions must be used within 365 days upon clicking agree to this Contract. If the Client wishes to pay for additional training sessions they will do so via our online store and will abide by the new contract upon the sale of those new sessions. Personal/Virtual/Group Training Sessions and subscriptions are subject to price change upon discretion of StrongerNow.
Online Coaching Programs: The Client will be billed according to the subscription or package purchased. The Client will be purchasing a pre-determined amount of online coaching specified in the online store and cart. Upon purchase of the subscription on the online store the Client agrees to the billing schedule outlined in the cart for the entirety of the program. Upon completion of their purchased plan, the Client will automatically engage in a month to month billing cycle depending on the product purchased, unless the Client specifically stated they are cancelling their subscription via written request. The Client must cancel their month to month subscription to the program at minimum 14 days prior to their next regularly scheduled payment. Weekly Coaching Calls have the same cancelation policy as outlined below under Cancellation of Virtual Training Sessions. Clients must use each weekly Coaching Call by the end of the calendar week or they will forfeit that Coaching Call.
Cancellation of Personal/Virtual/Group Training Sessions: The Client shall provide twenty-four (24) hours notice of any necessary cancellation of a scheduled Personal/Virtual/Group Training Session. Failure to provide twenty-four (24) hours notice shall result in the Client forfeiting the cancelled/missed Personal/Virtual/Group Training Session.
Indemnity: The Client agrees to indemnify and hold harmless StrongerNow and its Coaches for any injuries, illnesses, and the like experienced as the result of the Client’s Personal/Virtual/Group Training Sessions.
Termination: Either StrongerNow or The Client may terminate this Contract (10) days upon the purchase of the package or subscription without reason or further notice. Upon termination of the contract StrongerNow agrees to pay back all payments of unused Personal/Virtual/Group Training Sessions. If the Client has received their log-in credentials and program for the Online Coaching Program subscription they will not be able receive a refund for the first month billed on their contract. Following months payment if already paid will be returned.
Warranties: While StrongerNow and their Coaches fully believe exercise, specifically exercise personalized to the Client, is beneficial to the Client’s health and wellness, StrongerNow and their Coaches cannot guarantee the results of Personal/Virtual/Group Training Sessions and the Online Coaching Program. StrongerNow and their Coaches make no representations and/or warranties that Client will lose weight, gain muscle mass, be able to engage in any specific physical and/or athletic activity, or will attain any other particular and/or specific results. StrongerNow and their Coaches strongly encourage the Client to follow a healthy diet in conjunction with personal training and continued exercise.
Social Media and Marketing: I grant StrongerNow the right to use at any and all times and without notice to me, any and/or all images, pictures or videos taken by StrongerNow for use in all forms and media and in all manners for all purposes of promitional and marketing, without further fee to me.
Entire Agreement: This document reflects the entire agreement between the Parties and reflects a complete understanding of the Parties with respect to the subject matter. This Contract supersedes all prior written and oral representations. The Contract may not be amended, altered or supplemented except in writing signed by both Company and Client.
Dispute Resolution and Legal Fees: In the event of a dispute arising out of this Contract that cannot be resolved by mutual agreement, the Parties agree to engage in mediation. If the matter cannot be resolved through mediation, and legal action ensues, the successful party will be entitled to its legal fees, including, but not limited to its attorneys’ fees.
Legal and Binding Contract: This Contract is legal and binding between the Parties as stated above. This Contract may be entered into and is legal and binding in Canada and the United States. The Parties each represent that they have the authority to enter into this Contract.
Severability: If any provision of this Contract shall be held to be invalid or unenforceable for any reason, the remaining provisions shall continue to be valid and enforceable. If the Court finds that any provision of this Contract is invalid or unenforceable, but that by limiting such provision it would become valid and enforceable, then such provision shall be deemed to be written, construed, and enforced as so limited.
Waiver: The failure of either party to enforce any provision of this Contract shall not be construed as a waiver or limitation of that party’s right to subsequently enforce and compel strict compliance with every provision of this Contract.
Applicable Law: This Contract shall be governed and construed in accordance with the laws of the province where the Business is located, without giving effect to any conflicts of laws provisions.

The Client is engaging StrongerNow for Personal/Virtual Training/Group Services or the Online Coaching Program to be provided by StrongerNow Coach(es).
The Coach will create an exercise program geared to the Client’s fitness level and experience in order to meet the Client’s objectives.
The Coach will be assigned to the Client by StrongerNow and is subject to change at any time. The Client may request a new Coach and StrongerNow will make every effort to accommodate if circumstances allow.
The Client agrees to sign the attached Informed Consent and Assumption of Risk and Release of Liability.
The Client agrees to inform StrongerNow and the Coach of any and all conditions, medical or otherwise, that may affect his/her ability to participate in Personal/Virtual/Group Training Sessions and the Online Coaching Program.

INFORMED CONSENT AND ASSUMPTION OF RISK AND RELEASE OF LIABILITY

This Informed Consent and Assumption of Risk and Release of Liability is entered into upon click accept to the terms on the cart on the day of which the online sale takes place (“Effective Date”) and is material to the Virtual/Personal/Group Training Contract or the Online Coaching Program and is incorporated herein by reference.

The Client certifies that he/she is of adequate physical condition to participate in physical exercise.
The Client certifies that he/she assumes the risk of physical injury, whether minor, severe, or otherwise.
The Client certifies that he/she will not hold StrongerNow or its Coach(es) liable for any physical injury, whether minor, severe, or otherwise that result from Personal/Virtual/Group Training Sessions or the Online Coaching Program.
Client certifies that he/she assumes all responsibility for his/her participation in the Personal/Virtual/Group Training Sessions or the Online Coaching Program .
Client certifies that he/she will disclose to the Coach whenever suggested activities cause distress beyond Client’s threshold.

BY CLICKING ACCEPT ABOVE, THE CLIENT ACKNOWLEDGES HAVING READ AND UNDERSTOOD THIS CONTRACT AND THAT THE CLIENT IS SATISFIED WITH THE TERMS AND CONDITIONS CONTAINED IN THIS CONTRACT. THE CLIENT SHOULD NOT SIGN THIS CONTRACT IF THERE ARE ANY BLANK SPACES. YOU ARE ENTITLED TO A COPY OF THIS CONTRACT AT THE TIME YOU SIGN IT.
