(READ CAREFULLY TO THE END) MEDICAL WAIVER/RELEASE + INFORMED CONSENT + CANCELLATION POLICY
I agree that if I engage in any physical exercise, class, or activity, I do so at my own risk. I agree that I am voluntarily participating in activities and assume all risks of injury or illness.
I agree to release and discharge (coach) Hedieh Rashidimalekshah (Hedi Shah) and all other coaches and practitioners involved in her business from any and all claims or causes of action (known or unknown) arising out of my negligence. I acknowledge that I have carefully read this waiver and Release and fully understand that it is a release of liability. I am waiving any right that I may have to bring legal action to assert a claim against my trainers, instructors, and coaches for negligence.
General Statement of Program Objectives and Procedures:
I understand that this coaching program may include exercises to build the cardiorespiratory system (heart and lungs), the musculoskeletal system (which involves muscular endurance, strength, and overall flexibility), and to improve body composition (increasing muscle tissue and bone density and decreasing body fat). Exercise includes aerobic activities, including but not limited to walking, running, cycling, rowing, and swimming; resistance training using dumbbells, machines, and other equipment to improve muscular strength and endurance; and flexibility exercises to improve joint range of motion.
Description of Potential Risks:
I understand that the reaction of the heart, lungs, blood vessels, and neurological systems to exercise cannot always be predicted with accuracy. I know there is a risk of abnormal changes occurring during exercise, which include abnormalities of blood pressure or heart attacks and other side effects. I also understand weight lifting and callisthenics training may lead to musculoskeletal strains, pain, and injury if adequate warm-up, gradual progression, and safety procedures are not consistently followed.
I understand that Hedi Rashidimalekshah (Hedi Shah) (seller) shall not be liable for any damages arising from personal injuries sustained by the client (buyer) while and during the coaching program. The client (buyer) using exercise equipment does so at his/her own risk. The client (buyer) assumes full responsibility for any injuries or damages which may occur during and/or after training.
I hereby fully and forever release and discharge Hedi Rashidimalekshah (Hedi Shah) (seller), its assigns, and agents from all claims, demands, damages, rights of action, present and future therein.
I understand and warrant, release, and agree that I am in the good physical condition and that I have no disability, impairment, or ailment preventing me from engaging in active or passive exercise that will be detrimental to my heart, safety, comfort, or physical condition if I engage or participate (other than those items fully discussed on the health history form).
I state that I have had a recent physical checkup and have my personal physician’s permission to engage in aerobic and/or anaerobic conditioning.
Description of Potential Benefits:
I understand that a regular exercise program for the heart, lungs, muscles, and joints has many benefits associated with it. These may include decreased body fat, increased muscle mass, increased energy, improvement in blood fats and blood pressure, improvement in physiological function, and a decrease in heart disease.
I understand that results vary between individuals and depend on various factors, including but not limited to compliance with the program, genetic make-up, hormonal balance, and lifestyle factors.
Cancellation Policy (read carefully)
1. Private and Fluidity Training Agreement
∙ Cancellation or rescheduling notice must be given at least 24 hours ahead of time.
∙ If you are committed to the three-month package and decide to cancel your commitment, you have to pay 50% of the remaining agreed amount.
∙ The purchased package must be used within the defined time frame of the contract plus 14 days. For example, if your agreement is for three months, your contract will be over after 104 days.
∙ There is no refund policy.
∙ Packages and sessions cannot be transferred to anyone else.
∙ In the event of a session being cancelled with less than 24 hours’ notice, you will have the session credited back to you.
∙ The coach will sometimes take photographs/video footage for marketing purposes; if you have an objection to this, please inform the coach at the time.
I have read the above information and understand it. Any questions, which may have occurred, have been answered to my satisfaction.
2. The House Membership Policy
∙ The membership is on a month-to-month subscription basis or 3-month full payment.
∙ No cancellation will be accepted after the class starts or in the middle of the monthly cycles.
. A 2-week notice is required to stop the subscription.
∙ Classes cannot be carried over from one block to another unless under exceptional circumstances.
