Roslyn Claire helps people learn to rewrite their story to find their purpose through Theta Healing and Embodiment Sessions.

This Terms of Engagement ("the Agreement") is between Roslyn McPhail ABN 11 273 100 123 trading as Roslyn Claire Healing (the "Practitioner", "Roslyn Claire", "Roslyn") and YOU (the "Client") for services provided to you.

You have engaged Roslyn Claire Healing to provide one or more of the following services described below.

Please read this document carefully. If you have any questions or wish to discuss any aspect of this Agreement, please contact Roslyn Claire on roslynmcphail@gmail.com.

While it is expected that this Agreement will be signed and returned by you, you are deemed to have read and accepted the Terms and Conditions contained in this Agreement upon receipt by you via email, AND by continuing to accept and engage the services of Roslyn Claire Healing.

TERMS AND CONDITIONS

1. SERVICES

1.1 Roslyn Claire Healing provides wellness services tailored to each Client's healing or wellbeing goals.

1.2 Each service is listed below.

Additional services

1.3 Roslyn Claire may include additional services, or the inclusions may change to suit client needs and requirements,

1.4 This Agreement applies to any agreed additional services.

1.5 Additional services (detail and cost) will be confirmed with the Client by email.

Current services and packages

1.6 Womens Circles - 8 week circle for $333

1.7 90 minute Healing - $222 incl GST

1.8 3, 6 and 12 month packages as per details on website,

2.1 Roslyn Claire offers all healing services via telephone or Zoom.

2.2 All Healing sessions are by appointment only.

2.3 Clients can view session availability via Roslyn's website, Facebook page, or Instagram.

2.4 All sessions must be booked and completed within the agreed timeframe.

2.5 Any changes to the session times or delivery must be requested in writing to roslynmcphail@gmail.com.

Rescheduling

2.6 Rescheduling of sessions is permitted via the booking software.

Cancellation or No Show

You understand and agree:

2.7 You may reschedule your session time more than 24 hours before your booked session; however, cancellation within 24 hours of your session or a no show will result in forfeiture of the session.

2.8 An additional session is considered a new booking and will be invoiced accordingly.

3. PAYMENT

You understand and agree on the following payment conditions apply:

3.1 Full payment of the Fee for each service or package is required before the first session.

3.2 Pricing is valid for the term of the service provided.

3.3 Roslyn Claire is not under any obligation to maintain the same offer or pricing should you wish to extend the service term.

3.4 All prices are stated in Australian Dollars and include GST.

3.5 All payments are required to be paid online via our third-party payment gateway, currently Square.

3.6 Payment via credit/debit card attracts a maximum of 2.2% surcharge.

Payment Plan

3.7 A payment plan is available by negotiation and must be agreed to by you and Roslyn Claire before the commencement of any service engagement.

3.8 Where a payment plan is negotiated with Roslyn Claire, you agree to the following

● 5% premium will apply.

● Payments, according to the payment plan, are paid monthly in advance.

● All payments under a payment plan must be completed before the final session of the relevant service package.

● Payments are made online via a direct debit or credit card deduction from your nominated credit card, via Square.

4. REFUND POLICY

4.1 Roslyn Claire provides a unique service, the results of which may be life-changing and at times intangible.

4.2 The process to work with Roslyn requires Roslyn to access her inner reserves and for you to be open and committed to the healing process.

4.3 Where difficult issues arise for you, you agree to allow Roslyn to mentor you through these issues.

4.4 A refund will be considered if both parties agree, after discussion, that working together is not in the best interests of either or both parties.

You understand and agree:

4.5 Requests for refunds are considered on a case by case basis and may be offered at Roslyn Claire's discretion entirely.

4.6 Any refund calculation will include a deduction for the services completed by Roslyn Claire, plus a cancellation fee of 10% of the amount of your invoice for total service.

4.7 All requests for refunds must be made in writing to Roslyn Claire detailing the reason for your request.

4.8 Refunds will not be considered or issued for a change of mind.

5. CLIENT OBLIGATIONS

You understand and agree:

5.1 Working with Roslyn Claire requires open communication.

5.2 You may experience challenges and difficulties because of conditioned perceptions and patterns. These can often be resolved with open and honest communication and full disclosure about how you feel and think.

5.3 If you are experiencing any discomfort, challenges, or difficulties, you are requested to raise them with Roslyn immediately to support navigating these challenges and progressing your journey.

5.4 You will be required to be honest and straightforward in your responses to questions put to you during your sessions with Roslyn Claire.

5.5 It is your responsibility to:

● follow weekly directives, complete daily or weekly meditations, reflections or visualizations as advised

● read and complete the actions as requested in your "follow Up email".

Communication

5.6 All questions and queries are to be directed to Roslyn Claire via email.

5.7 Communication is managed via Zoom, an application for interactive communication.

Session Preparation

5.8 You will prepare for each session based on the directives provided each week.

5.9 You will be ready on time for each healing session.

5.10 Where your call is via Zoom, you will ensure you are somewhere private and undisturbed so you can be completely present during your session.

Facebook Group (group healing)

5.11 The private Facebook Group is by invitation only.

5.12 The Facebook Group's sole purpose is to provide a private forum to access group healing and downloads from Roslyn Claire.

5.13 You agree to abide by the Facebook Group rules of conduct, privacy and confidentiality of group discussions, member details and posts relating to their personal stories, including their businesses.

5.14 You are prohibited from promoting your business, other Facebook groups and providers of other healing services, in the Facebook Group or by private message to other group members.

5.15 Toxic, abusive and disrespectful conduct will result in removal from the Facebook Group.

5.16 Sharing of posts from the Facebook Group, including images, is strictly prohibited. This conduct will result in immediate removal from the group.

5.17 You will respect the confidentiality of each member of the Facebook group.

5.18 You will not discuss another member or their personal stories in either an individual or professional context outside the group for any reason without the Member's express written permission.

6. INTELLECTUAL PROPERTY

6.1 Roslyn Claire owns all Intellectual Property and related material (the "Intellectual Property"), including but not limited to workbooks that are developed or produced under this Agreement or through the course of or arising out of working with you.

6.2 The Client is granted a non-exclusive limited-use license (personal only) of this Intellectual Property.

6.3 The title, copyright, intellectual property rights and distribution rights of the Intellectual Property remain exclusively with Roslyn Claire Healing.

7. ACKNOWLEDGMENT & DISCLAIMER

You understand and agree:

7.1 Healing with Roslyn Claire results in both tangible and intangible results. It may include an energy release, a shift in mood or emotional state, an increased sense of internal wellbeing, a shift in how you view your world.

7.2 Roslyn Claire brings to your healing experience her training, personal and professional experiences, and her perceived truth to guide you (creators perceived truth, Universal perceived truth).

7.3 At all times, you are responsible for your decisions in choosing the path you take for your healing and self-development.

7.4 You have engaged Roslyn Claire Healing services at the agreed Fee.

7.5 Roslyn Claire Healing cannot guarantee any results for you. As such, you are 100% responsible for your progress and outcomes.

7.6 You accept that given the highly personal and tailored nature of Roslyn Claire Healing's services, every client's results will differ; you accept responsibility for any such variance.

7.7 Roslyn Claire is not a psychologist, psychiatrist, or otherwise medically trained and is not medically qualified to assess specific physical or mental conditions.

7.8 Any information or guidance provided by Roslyn Claire Healing is not a substitute for the consultation, diagnosis, and/or medical treatment of your doctor or healthcare provider.

7.9 You must not rely on any information or guidance we provide you with as an alternative to medical advice from your doctor or healthcare provider.

7.10 We expressly disclaim all responsibility and shall have no liability for any damages, loss, injury, or liability whatsoever suffered by you or any third party as a result of your reliance on any information or guidance we provide you with.

7.11 If you have any specific questions or concerns about any medical matter, you should consult your doctor or healthcare provider as soon as possible.

7.12 If you think you may be suffering from any medical condition, you should seek immediate medical attention from your healthcare provider.

7.13 Do not delay seeking medical advice, disregard medical advice or discontinue medical treatment because of the information or guidance we provide you with.

7.14 Nothing in this disclaimer will limit or exclude any liability that may not be limited or excluded by applicable law.

8. CONFIDENTIALITY

8.1 In working together, the relationship must be built on trust; thus, Roslyn Claire Healing is committed to the utmost confidentiality.

8.2 All information (written or verbal) that you share with Roslyn Claire Healing, and vice-versa, as part of the healing relationship will be kept confidential (unless disclosure is required by law such as fear for your or another person's safety or through court order or subpoena).

8.3 Roslyn Claire Healing agrees to keep details of all consultations, sessions, client information, and associated data shared for purposes required to complete the contracted services confidential during and after the period of this agreement.

8.4 While every effort will be made to maintain security and confidentiality of all information shared, Roslyn Claire Healing takes no responsibility for the security of information shared via third-party applications such as email providers or social media platforms that may be accessible to third-parties.

8.5 Roslyn Claire Healing will not use your name as a reference without first receiving written consent.

8.6 If single session calls are being recorded, Roslyn Claire Healing will inform the Client of the intent to record.

8.7 The recordings will not be made public in any way unless written agreement is sought from the Client.

9. LIMITATION AND LIABILITY

9.1 Liability for the services provided by Roslyn Claire Healing is governed solely by the Australian Consumer

Law and these Terms and Conditions.

9.2 Nothing in these Terms removes your Statutory Rights as a consumer under Australian Consumer Law.

9.3 To the extent permitted by law, Roslyn Claire Healing excludes all express or implied representations, conditions, guarantees, warranties and terms relating to any Services except those set out in this Agreement, including but not limited to implied or express guarantees, warranties, representations or conditions of any kind, which are not stated in this Agreement.

9.4 Roslyn Claire Healing guarantees all services are supplied to you with due care and skill and fit for the purpose that the services have been advertised.

9.5 To the extent that Roslyn Claire Healing is unable to exclude liability; total liability for loss or damage you suffer or incur from services by Roslyn Claire Healing is limited to re-supplying the Services to you, or, at Roslyn Claire' option, refunding to you the amount you have paid for the Services to which your claim relates.

10. WARRANTY AND INDEMNIFICATION

10.1 Roslyn Claire warrants healing services will always be carried out:

a. diligently;

b. with proper care and skill; and

c. in accordance with the terms of this Agreement;

10.2 The Client indemnifies Roslyn Claire against all claims for any legal relief whatsoever arising in any way out of or in connection with:

a. the carrying out of, or failure to carry out the contracted services; or

b. any breach of this Agreement.

10.3 The indemnity does not apply to the extent that any claim is caused by the negligence or breach of this agreement by the Practitioner.

11. TERMINATION

11.1 Either Party may terminate this Agreement by providing seven (7) days' notice in writing to the other Party.

Termination by Roslyn Claire Healing

11.2 Except as provided in this Agreement, where this Agreement is terminated with or without cause and through no action or fault of the Client, any payment for unfulfilled services without any fees or charges will be refunded to the Client.

11.3 Payment for fulfilled services will not be refunded.

Termination by Client

11.4 Except as provided in this Agreement, where the Client terminates this Agreement, the Client is liable for all outstanding fees. Payment is required in full within seven (7) days of the termination date.

11.5 Payment for fulfilled services will not be refunded.

12. Concerns and issues

You understand and agree:

12.1 You will contact Roslyn Claire immediately with any concerns to be resolved quickly and effectively through friendly consultation.

12.2 In the unlikely event, a dispute cannot be resolved in the first instance; the following Dispute Resolution Procedure must be followed:

● You must advise Roslyn Claire in writing of the nature of the dispute, the outcome you seek and what actions you believe will settle the dispute.

● You agree to meet in person or Zoom in good faith to resolve the dispute by agreement and compromise.

● You agree to meet in person, via Zoom or a similar online platform, in good faith to seek to resolve the dispute by agreement and compromise.

12.3 If an agreement cannot be reached to resolve the dispute, any party may refer to a mediator appointed by the Law Society of Victoria to determine the time and place for mediation.

12.4 Both parties must attend the mediation in good faith to resolve the dispute through mediation or other alternative dispute resolution processes.

12.5 The parties agree that legal action will only be commenced if mediation is unsuccessful.

12.6 Confidentiality is paramount to both the reputation of both Parties.

12.7 At no time will any communications or discussions be made public. This includes but is not limited to any social media platforms or websites of either Party.

12.8 Any public discussion or comments about either party will be considered defamatory, harmful or otherwise damaging and will be the subject of compensation in any mediation or litigation claim.

13. GOVERNING LAW

13.1 The laws of Victoria, Australia, govern the Terms and Conditions of this Agreement.
