This contract confirms the terms of agreement and services. All terms are final and not subject to negotiation. The terms of this agreement are subject to revision or amendment at any time by Chunky Monkey Photography. Please note that the terms of this agreement are binding on both parties.

Chunky Monkey Photography shall provide services to photograph you and your family to the best of the photographer’s ability. Any artistic interpretations by the photographer will be deemed acceptable, agreeable and pursuant to the creative control of the photographer. The photographer reserves the right to terminate this agreement at any time for any reason and will provide verbal or written notice to you and your family within a reasonable amount of time prior to the photo session. The photographer will not be liable for termination of this contract. Reasons for termination may include but are not limited to; illness, traffic conditions, acts of nature, and family occurrence.

Chunky Monkey Photography will not be held responsible or liable for the failure to obtain certain images if the management or owner of a location during any portion of the photo session requires the parties to leave the premises. Chunky Monkey Photography will make every reasonable attempt to capture the client’s desires to the best of the photographer’s ability and within the confines provided by the locations chosen. Chunky Monkey Photography will not be responsible or liable if specific shots, poses or angles are not captured. Failure to capture specified shots, poses or angles will not result in partial or full refund. Chunky Monkey Photography is not responsible for weather, client cooperation, client participation and technical difficulties. Portrait sessions generally last anywhere between 1-7 hours depending on the nature and location of the session; however, the photographer, at her discretion, may end a session if she has captured an adequate quantity and quality of images. Packages must be used within the timeline given or other sessions will be forfeited. Extended time will only be allowed due to illness.

RETAINER, PAYMENT & PRICING

The client shall remit a non-refundable retainer fee to reserve the date of services for the portrait session. If rescheduling takes place after the 6 month mark, a new retainer may be required. The Creative Session fee includes photographer time, talent and will include digital edited images. Chunky Monkey Photography cannot guarantee the number of proofs for the session, and may fluctuate from 5-30 images. Sales tax will be collected on the full amount paid. Any cancellations 72 hours before the session date will result in a rescheduling fee of $250.

PROOFING, COPYRIGHT AND REPRODUCTION

Average turnaround time to receive edited photos is approximately 2-4 weeks. Images are given individual attention and are corrected for color balance, density, contrast, sharpness, blemishes etc. Chunky Monkey Photography is granted complete artistic control over the proofing and editing of all images. The photographer will notify the client when the edited photos are ready for viewing and will setup a gallery. All work, product and proofs captured from a session are copyrighted and protected under intellectual property rights held exclusively by Heather Bush and Chunky Monkey Photography. Images can be shared online, including Google+, Facebook, blogs, etc. with proper credit given and a link to www.ChunkyMonkeyPhotography.com. Images cannot be used for commercial purposes, submitted to contests, casting calls or used in another other matter without written permission. Reproduction, alteration or scanning of any proof without written release is a violation of copyright laws.

RELEASE OF LIABILITY & SEVERABILITY

Chunky Monkey Photography will not be responsible or liable for dissatisfaction due to circumstances beyond the photographer’s control. Chunky Monkey Photography reserves the right to refuse a requested location for any reason. In the event that photographic materials are damaged or lost through camera or computer malfunction, Chunky Monkey Photography shall take reasonable measures to retake the session whenever possible or provide a refund of the cost of the session if the images cannot be retaken. Upon refund of a session fee or termination of this agreement, Chunky Monkey Photography is released of all obligation, responsibility, and liability to the client. The client understands that the style of photography produced will be similar to the style, artistic creativity, and caliber displayed on the Chunky Monkey Photography website, blog and promotional materials.

It shall be the responsibility of the client to ensure the safety of those being photographed at all times. The safety of those being photographed is always a top priority. It is the responsibility of the client to inform all subjects involved in the session of the terms of this agreement. Should any of the clauses, sentences, paragraphs, sections or parts of this agreement be deemed invalid, or unenforceable by a court of law with jurisdiction over the matter, such action shall not be construed to affect any other valid portion of this agreement.

MODEL RELEASE

The client grants that Chunky Monkey Photography may use any images taken at the portrait session for the purpose of its business and services; including but not limited to: website, blog, studio display, promotional materials, photo exhibits, mentoring packages and product demos. The right to edit and approve for public use is granted to the client.
