We are so excited you have chosen Modern Space as a place to make your creative vision come to life. Below you will find an overview of our policies, rules, and restriction for the Studio. We have these terms in place to ensure the Space is an enjoyable for everyone who comes through the doors.

Reservation
Client’s rental time begins promptly at the designated starting time and ends promptly at the designated ending time. Time includes set up break-down and cleaning times. Studio must be cleaned and vacated by the end of the rental period. No prior drop-off and/or pick-up after completion of shoot, of equipment, props, etc. unless negotiated at time of rental contract. Additional fees may apply. Early or extended hours must be worked out and paid for in advance before rental period begins.

If client stays past or enters before allotted time, they will be charged at a rate of $5 per minute.

Cancelling or Changing Your Reservation
ALL PAYMENTS ARE FINAL. You can reschedule your reservation with no additional charge at any time before your reservation is set to begin. If reservation is cancelled, you will receive a credit for the amount of hours booked that can be applied towards a future rental at Modern Space Your credit will never expire from the date of the original reservation. Restrictions
-Furniture in the Boudoir Space may not be moved.
-Those who do Boudoir in the Studio, please be mindful that the front is windows, we will have privacy curtains installed, in the meantime please use rolling backdrops to block out windows.
-No smoking whatsoever is allowed in the studio (including shooting area, bathroom, or behind building)
-Glitter and confetti is not allowed!
- Water allowed only no other beverages to ensure our equipment remains in good condition.
-No illegal drug usage allowed.
- We do provide smart speakers, when you walk in just say, "Hey Google Play(whatever band you want to listen to) and it will turn on, please make sure to turn music off when exiting. Music/voices are to be kept at reasonable levels to not to disturb residents of the area and not contain vulgar or offensive lyrics or words.
-Children must be supervised at all times.
-Candles must be in holders that prevent wax from dripping on surfaces.
-Nails, tacks or staples may not be used in the walls. You may hang with command hooks. Nothing else.
-Set up and breakdown times must fall within the total rental period reserved. It is the responsibility of Renter and its vendors to set up, breakdown, and move equipment and other items within the Studio.
-Renter may not sublease the Studio to any third party.

Boudoir Photography
-Explicit sexual activity is strictly prohibited.
-If you will be doing Boudoir and wish to have the cameras not be recording please email us 24hrs in advance so we can ensure of your privacy.

We encourage all changing of clothes be done in the bathroom.

Damage and Cleaning
-Client agrees to leave the Studio and all contents and fixtures in the same condition as they were when client arrived. All items (including but not limited to furniture, props and set items, wrapping material, food / food leftovers etc.) brought to the Studio by client are to be removed by client.
If the Space is not in the same condition when rented, Renter agrees to pay, as applicable (i) a minimum of a $200 cleaning fee (this may increase at owners discretion if owner decides more hours will be needed to clean the Studio). For premises / property damages (ex: damages to furniture, floor, building / gate etc.) client agrees to pay total repair charges charged by a vendor selected at owner’s discretion.

ARBITRATION and MISCELLANY

If the parties are unable to resolve any controversy or claim arising under this Agreement, they agree to submit the dispute or claim to binding arbitration subject to the commercial arbitration rules of the American Arbitration Association. This arbitration will take place in Dallas County, Texas. The parties further agree that any such controversy or claim shall be submitted to one arbitrator selected from the panels of arbitrators of the American Arbitration Association. Each party shall be responsible for its share of the arbitration fees in accordance with the applicable Rules of Arbitration. In the event a party fails to proceed with arbitration, unsuccessfully challenges the arbitrator's award, or fails to comply with the arbitrator's award, the other party is entitled to costs of suit, including a reasonable attorney's fee for having to compel arbitration or defend or enforce the award. Notwithstanding the foregoing, either party may refuse to arbitrate when the dispute is for a sum less than $100.

Photographer shall comply in all respects with all federal, state, county, city, or other local laws, regulations and ordinances and all rules and regulations of any governmental authority, in connection with this Agreement. This Agreement incorporates the entire understanding and
agreement between Company and Photographer. Any modifications of this Agreement must be in writing and signed by both parties. Any waiver of a breach or default hereunder shall not be deemed a waiver of a subsequent breach or default of either the same provision or any other provision of this Agreement. The laws of the State of Texas shall govern this Agreement. The following signatures constitute a legal and binding Agreement between Photographer and Company.
Once you access the Studio, if you feel there is damage to any of the furnishings, props, or Space we should be aware of, please contact us immediately.

WAIVER OF LIABILITY

Use of Company’s Premises and equipment is at Photographer’s risk. Photographer hereby agrees that Company will not be held liable for any direct, indirect, incidental, or consequential damage, injury or loss to Photographer, his party, or possessions while on the Premises. Photographer holds harmless and indemnifies Company and its owners, agents, representatives, associates, officers, employees, guests and tenants against any suit, claim, loss, accident, judgment, fine, injury or damages, including reasonable attorney’s fees. This indemnification shall continue in full force and effect during and after the term of the rental for such causes arising during the term of the rental.

LATE FEES
The guest that books the space will be assessed a late fee. The late fee is calculated by how many minutes past the original reservation the guest or The Group associated with the event leaves the space. The rate is $5 per minute every minute past the original reservation.

EARLY ARRIVAL FEES
The guest that books the space will be assessed an early arrival fee. The early arrival fee is calculated by how many minutes prior to the start of the rental period anyone in the photographer's party enters the building. The rate is $5 per minute every minute prior to the start of the original reservation.
