BY PROCEEDING WITH THIS PURCHASE, I AGREE TO THE FOLLOWING TERMS AND CONDITIONS.

ASSUMPTION OF RISK OF AND WAIVER AND

RELEASE OF LIABILITY

In this Agreement, “You” refers to a person or the parent or guardian of a minor participating in activities offered by Light Fusion Yoga, LLC (“LF”). Light Fusion Yoga, LLC (“Light Fusion”) provides instruction, guidance, and classes in yoga and other health practices related to yoga (Activities).

1. Activities involve movement and stretching, sometimes in body positions that may be difficult or unfamiliar to you. As a result, there is a risk of injury from Activities. LF strongly recommends that you consult with your health care provider prior to any classes as to whether Activities are recommended for you and what limitations, if any, you may have with regard to Activities. You should also disclose and describe any physical or health conditions to the instructor that you may have that may limit your ability to participate in Activities or that may require modification of some of the approaches that you might take to the Activities. Always be mindful of your body’s reaction to Activities and immediately cease any Activity or movement that causes pain or concern to you. Yoga can sometimes by uncomfortable, but it should not be painful. You must follow all safety instructions presented to you by the instructor.

2. If you have any conditions such as pregnancy, post-natal or post-surgical conditions, serious wounds, skeletal or spinal conditions, arthritis, asthma or other respiratory problems, you acknowledge that you have your health care provider’s approval to participate in Activities.

3. Other injuries may occur as a result of other factors too numerous to mention here. If you have any questions regarding the types of risks that are associated with the Activities, please discuss them with LF before you sign this Agreement.

4. You understand that there are inherent risks associated with Activities and that certain Activities are inherently dangerous and include the potential for bodily injury (for example, without limitation, leg, neck, back, or muscle injuries), pain and suffering, trauma, paralysis or death arising out of participation in Activities that may be beyond your physical limitations or the unpredictable behavior of your body in unfamiliar conditions. You agree that the risks associated with Activities are beyond the immediate control of LF, are not readily foreseeable. (“Risks”)

5. Assumption of Risk: You understand that there are many other activities available to you that do not carry the same Risks and that your participation is a recreational activity that is by no means mandatory. You understand the aforementioned Risks may be caused in whole or in part, directly or indirectly from your own negligent actions or inactions, and you explicitly, voluntarily, and knowingly ASSUME THE RISKS associated with Activities, and agree to be responsible for any injury or damage resulting to you that arise or are related to your participation in Activities.

6. Waiver and Release of Claims: You, the undersigned, on behalf of Yourself, any minor for whom You are the guardian, Your heirs and successors in interest, now and forever waive, release and discharge LF, its shareholders, directors, officers, employees, agents, successors and assigns from any and all claims, demands, losses, expenses, damages, liabilities, actions, causes of action of any nature, including but not limited to personal injury, wrongful death and property damage, that in any manner arise from or relate to Activities. This waiver and release extends to and includes any and all claims, liabilities, injuries, damages, and causes of action that the parties do not presently anticipate, know, or suspect to exist, but that may develop, accrue, or be discovered in the future. You, the undersigned represents and warrants that You have considered the possibility that claims, liabilities, injuries, damages and causes of action may develop, accrue or be discovered in the future, and You voluntarily assume that risk as part of this agreement.

7. COVENANT NOT TO SUE. You covenant on behalf of Yourself, and any minor for whom You are the parent or guardian, that You will never directly or indirectly institute any legal, equitable, administrative, or other action, complaint, or proceeding against LF or any shareholder, director, officer, employee, agent, successor or assign thereof, or in any manner assert any further claim or demand against LF or its shareholders, directors, officers, employee’s, agents, successors and assigns thereof, arising from or relating to Your participation in Activities. This covenant applies and extends to any and all claims, liabilities, injuries, expenses, losses, damages, and causes of action whether or not You presently anticipate, know, or suspect such Risks exist or whether they may develop, accrue, or be discovered in the future.

8. TYPES OF FAULT INCLUDED: This Assumption of Risk and Waiver and Release of Liability includes all forms of fault whether it is defined as “negligence,” “gross negligence,” or “malicious.”

9. INDEMNIFCATION. You agree to indemnify, defend (by counsel reasonably acceptable to indemnity), protect and hold LF, its shareholders, directors, officers, employees, agents, successors and assigns, free and harmless from and against any and all claims, liabilities, penalties, losses, or expenses (including attorneys’ fees) for death of or injury to any person or damage to any property whatsoever arising from or caused in whole or in part, directly or indirectly, from any intentional or negligent act in which you cause property damage or harm another individual participating in the Activities.
