1. Payment & Fees

a. The Member agrees to pay the membership fee and any other fee that is required upon signing this Contract. Upon payment of those fees, the Member will have the non-exclusive right to attend LTA Group Classes within our public opening hours (as updated from time to time by LTA, and excluding the use any of the Studio closed for events and/or annual maintenance). In the event that the facilities are closed as outlined above, the Member will not be entitled to a refund of any fee paid.

b. The Member agrees that, when at LTA Studios, he or she must comply with all LTA policies and rules, as updated from time to time.

2. Membership Suspensions

a. We are able to pause memberships for maximum 30 days at a time with 14 days written notice

3. Direct Debit Memberships

a. Payments: The Member authorises payment of the membership fee by direct debit to LTA from the Member’s designated bank account.

4. Direct Debit Fees/Overdue Fees

a. Where a payment is declined, memberships are immediately terminated

b. LTA will not be held responsible for any fee charged to the Member by a bank where funds in the Member’s bank account were not sufficient to cover funds due.

c. Overdue Membership payments to LTA will result in entry not being permitted to the facilities.

d. Fees are non-refundable

5. Prepaid Memberships/Packages

a. The Member agrees to pay the membership fee and any other fee that is required upon signing this Contract. Upon payment of those fees, the Member will have the non-exclusive right to attend LTA Group Classes during our public opening hours (as updated from time to time by LTA, and excluding the use any of the Studio closed for events and/or annual maintenance). In the event that the facilities are closed as outlined above, the Member will not be entitled to a refund of any fee paid.

b. Membership Transfer: The Member may not transfer his/her membership to another person.

c. Renewal: Packages/Class Passes will not automatically renew at the end of the specified period.

6. Termination of Contract

a. Termination of Membership by LTA:

LTA may terminate this Contract if the Member:

(i) Fails to comply with this Contract; and/or

(ii) Fails to comply with LTA’s policies and rules relating to the use of the facilities (as they are updated from time to time); and

(iii). Where LTA terminates the Member’s membership under this clause, LTA shall have the right to seek recovery of all fees owing to it under this Contract along with all costs and expenses incurred by LTA in recovering those fees.

(iiii) The Member (Package Memberships only) shall not be entitled a refund of any ongoing membership or pre-paid amounts.

b. Termination of Membership by Member: The Member may terminate this Contract (whether a Direct Credit or Prepaid membership) at any time upon 14 days notice in writing via email provided that all the memberships’ fees and amounts owing under this Contract are paid in full.

c. Prepaid Packages: For the avoidance of doubt, the relevant membership fee for that term must be paid in full. Upon termination, the Member will not be entitled to a refund of any prepaid amounts.

7. Variation of Contract Terms

a. LTA may vary any of the terms of this Contract, including any fees payable by providing the Member two months’ notice in writing. In the event that notice is provided in accordance with this clause, the Member may:

(i) Accept the variation; or

(ii) Terminate the Contract without cost. Prepaid Packages shall be entitled to a refund of any remaining amounts on their packages

(iii) The Member must advise LTA of their decision to terminate the Contract within two weeks of receipt of the notice outlined in clause 7.a above. Any failure to do so will result in LTA assuming the Members acceptance of the variation outlined in the notice. The notice will stipulate the nature of the variation and the date that the variation(s) will come into force.

8. Limitation of Liability

Except as provided in the Consumer Guarantees Act 1993 or as provided elsewhere in this Contract, LTA to the extent permitted by law, shall not be liable or responsible to the Member for any direct or indirect or consequential injury, loss or damage to the person or property of the Member, whatsoever and howsoever arising.

9. Debt Collection Action

a. The Member authorises LTA to notify any debt collection or reporting agency if the Member defaults on his or her obligations under this Contract.

b. LTA shall add a $50 fee to the Member’s outstanding debt as its fee for dealing with the defaulting Member.

c. The Member agrees to pay all costs incurred as a result of debt collection including all commissions and fees charged by the debt collection agency (approx 25% in addition to the outstanding debt).

10. Privacy

a. When the Member provides personal information to LTA, we will comply with the New Zealand Privacy Act 1993.

b. The Member authorises LTA to use his or her personal information for the purposes of enforcing this Contract and of providing special product and service offerings to the Member.

c. The Member has right to access, and request correction of, all personal information that LTA holds about him or her.

LTA Group Class Policies

To help us ensure that LTA has a welcoming, safe and friendly atmosphere for our community, the following rules must be observed.

1. Wait at the Reception Area until you are welcomed by your Teacher

2. Place your personal items in cubby holes provided in the Changing Rooms. Bags are discouraged in the studios

3. Appropriate attire must be worn. No jeans, construction work wear, jandals, work shoes or boots. Footwear must be exercise appropriate as deemed by LTA staff. Shoes must be worn in the Reception area at all times but do not need to be worn in the Studios

4. We encourage you to bring a Mat & Sweat towel to every visit

5. Reduce the use of your phone to a minimum. Taking photo or video of others without their prior approval is not permitted. Please have it on silent in the Studio except under emergency situations.

6. Abusive and offensive language and threatening behaviour of any kind is not tolerated

7. Training under the influence of drugs or alcohol is not permitted

8. Under 16's are not permitted entry unless with prior approval from LTA Management

Failure to follow any of the above rules may result in termination of the members’ contract..

LTA Group Class Procedures

• All group classes can be booked online to secure a spot, however walk-ins are welcome.

• To make an online booking, log in at www.ltastudiosqt.com

• Select your desired class. Online bookings close 2 hours before the class

• Follow the prompts to make your class booking

• You will receive a confirmation email with a calendar reminder for the class you have booked

• You are able to reschedule your booked class at no extra cost. Please remember that cancellations/reschedules cannot be made within 2 hours of your class.

• Don’t forget to arrive at least 5 minutes before your class starts. Do not be late. If you are late & have missed the Warm-Up you will not be permitted into the class.

• 3 or more class ‘no shows’ within a month could result in a class stand-down period of one month

• Please follow the Teachers instructions throughout the class
