Liability Waiver Form

I/we realize that participation in dance classes and activities (the “Services”) could involve some possible personal injury and contacting COVID-19. Despite precautions, accidents, injuries and/or illness may occur. By signing this release form, I/we (the dancer and parent/guardian) assume all risks related to the use of any and all spaces used by Bachata Vida Dance Company, LLC dba Bachata Vida Dance Company (hereinafter “Bachata Vida Dance Company”).

I/WE AGREE TO RELEASE, INDEMNIFY, AND HOLD HARMLESS BACHATA VIDA DANCE COMPANY, INCLUDING ITS RESPECTIVE DIRECTORS, MEMBERS, EMPLOYEES, TEACHERS, DANCERS, STAFF MEMBERS, OFFICERS, SHAREHOLDERS, SUCCESSORS, SUBSIDIARIES, FACILITIES, FACILITY OWNERS, SUBCONTRACTORS, AND AGENTS, AND THOSE OF ITS AFFILIATES FROM AND AGAINST ANY AND ALL COSTS, EXPENSES, LOSSES, CLAIMS, JUDGMENTS, LIABILITIES, DAMAGES, SUITS, JUDGMENTS, DEMANDS, ACTIONS, OR CAUSE OF ACTION (INCLUDING, WITHOUT LIMITATION, REASONABLE ATTORNEYS’ FEES AND COURT COSTS) (COLLECTIVELY “CLAIMS”) NOW AND IN THE FUTURE, ARISING OUT OF OR RELATED IN ANY WAY TO MY, OR MY CHILD’S OR CHILDREN’S PARTICIPATION IN THE SERVICES. I/WE AGREE TO RELEASE, INDEMNIFY, AND HOLD HARMLESS BACHATA VIDA DANCE COMPANY FOR ANY PROPERTY DAMAGE OF ANY KIND, PERSONAL INJURY, OR DEATH WHICH MAY OCCUR ON THE PREMISES BEFORE, DURING, OR AFTER CLASSES, OR AT ANY COMPETITION, OR WHILE PARTICIPATING IN ONLINE CLASSES. FURTHERMORE, I/WE AGREE TO OBEY THE CLASS AND FACILITY RULES AND TAKE FULL RESPONSIBILITY FOR MY/OUR BEHAVIOR, AND THAT OF OUR CHILD/CHILDREN, IN ADDITION TO ANY DAMAGES I/WE OR MY/OUR CHILD/CHILDREN, CAUSE TO THE FACILITIES UTILIZED BY BACHATA VIDA DANCE COMPANY.

Bachata Vida Dance Company PHOTO/VIDEO RELEASE FORM

I/We hereby grant the Bachata Vida Dance Company, LLC and its assigns, permission to use, exploit, adapt, modify, reproduce, distribute, exhibit, and display in any form now known or later developed my or my child’s likeness in a photograph, video, or other digital media, including an audio file containing my or my child’s image or voice, (collectively the “Materials”) in any and all of its publications, including web-based publications, (the “Works”) without payment or other consideration.

I/We understand and agree that all Materials will become the exclusive property of the Bachata Vida Dance Company and will not be returned and I/We hereby voluntarily relinquish any and all rights, title, and interests in and to said Materials.

I/We hereby irrevocably authorize the Bachata Vida Dance Company, LLC to edit, alter, copy, exhibit, publish, or distribute the Materials for any lawful purpose. In addition, I waive any right to inspect or approve any works wherein my or my child’s likeness appears. Additionally, I waive any right to royalties or other compensation arising or related to the use of the Materials. I/We release, Bachata Vida Dance Company, LLC its agents, employees, licensees and assigns (collectively, “Released Entities”) from any and all claims I, my child, or any third party, may have now or in the future for invasion of privacy, right of publicity, copyright infringement, or any other cause of action arising out of the use, exploitation, reproduction, adaptation, distribution, broadcast, or display of the Materials.

I/We understand and agree that the Bachata Vida Dance Company, LLC is and shall be the exclusive owner of all right, title, and interest, including copyright, in the Works, and any promotional materials or other media or use containing the Materials.

I/We hereby hold harmless, release, and forever discharge the Bachata Vida Dance Company, LLC from all claims, demands, and causes of action which I/We, my heirs, representatives, executors, administrators, or any other persons acting on my behalf or on behalf of my estate have or may have by reason of this authorization.

Refund Policy

All sales are final. We do not issue refunds, except under extenuating circumstances of which Bachata Vida reserves the sole discretion and right to determine which cases would qualify for a refund or exchange.
