PARTICIPANT AGREEMENT, RELEASE AND ASSUMPTION OF RISK

In consideration of the services of Rise and Fly Fitness Studio, Rockbarre Studio, Rocki Hoop, Danielle Bregg, Laura Dunn, Alicia Moreland, Karla Gomez, Tayelor Pierce I hereby agree to release, indemnify, and discharge the above entities and persons above, as follows:

I acknowledge that my participation in acrobatic aerial arts training and instruction (including but not limited to Bungee Fit, Silks, Lyra, Aerial Yoga, Aerial Trapeze, Aerial Hammock, Pole Fitness) activities entails known and unanticipated risks that could result in physical or emotional injury, paralysis, death, or damage to myself, to property, or to third parties. I understand that such risks simply cannot be eliminated without jeopardizing the essential qualities of the activity. The risks include, among other things: slips and falls; falling from equipment; rope burn; pinches, scrapes, twists and jolts that could result in scratches, bruises, sprains, lacerations, fractures, concussions, or even more life threatening hazards; strains, muscle soreness and fractures; musculoskeletal injuries including head, neck and back; injuries to internal organs; the negligence of other people; my own physical condition; and the risk of emotional and psychological injuries or physical damage associated with this activity.

I expressly agree and promise to accept and assume all the risks existing in this activity. My participation in this activity is purely voluntary, and I elect to participate in spite of the risks.

I hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless the above mentioned entities and persons from any and all claims, demands, or cause of action, which are in any way connected with my participation in this activity, or my use of the equipment owned by the above named entities, including any such claim which allege negligent acts or omissions by Rise and Fly Fitness Studio, Rockbarre Studio, Rocki Hoops, Laura Dunn, Karla Gomez and Tayelor Pierce.

I certify that I have adequate insurance to cover injury or damage that I may cause or suffer while participating, or else I agree to bear the costs of such injury or damage myself. I further certify that I am willing to assume the risk of any medical or physical condition I may have.

All intellectual property including routines, choreography, combinations, class structure, photos and videos taken in class belongs to the Rise and Fly Fitness studio and cannot be duplicated, copied and used elsewhere without permission from the above entities and persons named above.

Any participants wishing to open their own acrobatic aerial classes, fitness classes, training or instruction may not do so in a 100 mile radius or within 5 years of participating in classes at Rise and Fly Fitness Studio and Rockbarre Studio without permission from named entities.

By signing this document, I acknowledge that if anyone is hurt or property damaged during my participation in this activity, I may be found in a court of law to have waived my right to maintain a lawsuit against Rise and Fly Fitness Studio, Rockbarre Studio, Rocki Hoops, Danielle Bregg Laura Dunn, Alicia Moreland, Tayelor Pierce and Karla Gomez on the basis of any claim from which I have released them herein.
