ACCIDENT WAIVER AND RELEASE OF LIABILITY FORM

I acknowledge that this Accident Waiver and Release of Liability Form will be used by ShapeShifts Coaching (SSC) LLC, its instructors, event organizers, sponsors, and affiliates for any activity in which I participate. I understand that this waiver governs my actions and responsibilities during such activities.

I acknowledge that SSC LLC, including its directors, officers, instructors, volunteers, representatives, and agents, is not responsible for the errors, omissions, acts, or failures of any third party conducting an activity on their behalf. Furthermore, SSC LLC is not liable for any injuries or incidents resulting from participants independently practicing or replicating classes, private lessons, or event activities on SSC premises or elsewhere.

I understand that participating in SSC classes, private lessons, or programs—including but not limited to those involving nutrition, movement, or other physical activities—may test my physical and mental limits and carries inherent risks, including but not limited to serious injury, disability, property damage, and even death. These risks apply not only to participants but also to volunteers, SSC employees, and owners. I willingly assume all such risks and release SSC LLC from any related liability.

I certify that I have disclosed to SSC all relevant health-related information that could affect my participation. I acknowledge that SSC operates within the scope of its certifications when providing guidance, but it remains my responsibility to seek medical clearance before engaging in any SSC plans or programs.

I assume full responsibility for any risks associated with my participation, including risks arising from negligence, defective equipment, or hazardous property conditions, whether owned, maintained, or controlled by SSC LLC or its affiliates.

I understand that by signing this waiver, it applies indefinitely and retroactively. I release SSC LLC from liability for any injuries, emotional distress, mental health conflicts, or other symptoms resulting from participation.

I acknowledge that SSC does not offer refunds under any circumstances. However, at SSC’s discretion, program pauses or transfers may be considered on a case-by-case basis.

I understand that copying, downloading, or sharing SSC’s protected content—including images, videos, and other proprietary materials—is strictly prohibited.

Release of Liability & Indemnification

In consideration of my participation, I, on behalf of myself, my executors, administrators, heirs, next of kin, successors, and assigns, agree as follows:

(A) WAIVER & RELEASE: I waive, release, and discharge SSC LLC, its directors, officers, employees, volunteers, representatives, and agents—as well as event holders, sponsors, and volunteers—from any and all liability, including but not limited to claims for death, disability, personal injury, property damage, or property theft, whether occurring during participation or travel to and from activities.

(B) INDEMNIFICATION & HOLD HARMLESS: I agree to indemnify, hold harmless, and not sue SSC LLC and the aforementioned parties for any claims or liabilities arising from my participation, whether caused by negligence or otherwise.

Medical Consent

I consent to receiving emergency medical treatment, including but not limited to CPR, AED use, first aid, or other medical interventions deemed necessary for my well-being. If I become unconscious or unable to make decisions, I authorize SSC LLC to act in what they believe is my best interest regarding my safety and health.

Cancellation and Reschedule Policy:

We require a 24-hour notice for any cancellations or rescheduling. Please note, due to the nature of our package planing and execution there are no refunds on packages once they have begun or on prepaid sessions. In some cases we may be able to transfer package type or credit. We appreciate your understanding and commitment to your wellness journey.

Final Acknowledgment

I understand that this waiver is legally binding and will be interpreted to the fullest extent permitted by law. This release applies to all locations where I engage in activities or programming with SSC LLC.

I certify that I am at least 18 years old and that I have read and fully understand the contents of this document. I acknowledge that by signing, I am voluntarily waiving legal rights and accepting full responsibility for my participation.
