THE MAINE PHOTO STUDIO, LLC RENTAL AGREEMENT

This Rental Agreement ("Agreement") is entered into by and between THE MAINE PHOTO STUDIO, LLC ("Studio") and the undersigned Renter ("Renter"). By signing this Agreement, Renter agrees to the following terms and conditions:

1. RENTAL TERMS

The Renter is granted access to the Studio space only during the scheduled rental time. Entry before or departure after the reserved time is not permitted unless additional time is pre-approved and paid for. Any extra time used will be invoiced to the Renter.
The Renter is responsible for securing the Studio by locking all doors and returning the key to the lockbox after the rental period.

2. LIABILITY RELEASE & INSURANCE REQUIREMENT

The Studio is not liable for any injuries, damages, losses, or claims incurred by the Renter, their clients, or any individuals in attendance during the rental period.
The Renter agrees to carry business insurance that covers any liabilities, damages, or injuries occurring during their use of the Studio.
The clauses addressing liability release and the requirement for renters to carry business insurance are prudent. While such provisions are generally enforceable, they should be reasonable and not unconscionable. Ensuring that renters are adequately informed about these requirements can further support their enforceability.

4. PAYMENT POLICY

The final rental payment is due no later than one (1) week before the scheduled rental date.
Failure to submit full payment by this deadline grants the Studio owner the right to cancel the rental appointmentwithout refund.

5. CANCELLATION POLICY

Cancellations made more than 14 days before the scheduled rental date will receive a full refund.
Cancellations made within 14 days of the rental date are eligible for a credit that must be used within three (3) months of the original booking.
Cancellations made within 24 hours of the rental time are non-refundable and non-transferable.

6. PROHIBITED ACTIVITIES

The use of fire, open flames, glitter, confetti, or tape on the walls or backdrops is strictly prohibited.
The Renter is responsible for ensuring that the space remains clean and undamaged. Any damages caused will be the financial responsibility of the Renter.

7. ANIMALS & PETS

Service animals or any other animals are only permitted with prior approval from the Studio owner.

8. RESPONSIBILITY & DAMAGES

The Renter assumes full responsibility for any damage to the Studio, its equipment, or any property therein.
Any necessary repairs or replacements due to damage caused by the Renter or their guests will be billed to the Renter.

9. SAFETY & CONDUCT

The Renter and their clients must conduct themselves in a safe and respectful manner while using the Studio.
The Studio reserves the right to terminate the rental period without refund if the Renter or their guests engage in unsafe, unlawful, or disruptive behavior.

10. USE OF EQUIPMENT & PROPS

The Renter is permitted to use available Studio equipment and props but must handle them with care. Any damages to equipment or props caused by the Renter will result in repair or replacement fees.
The Studio must be cleaned up and returned to the exact condition it was in upon arrival. Furniture, props, and equipment must be placed back in their original positions.
If the Renter requires specific props or equipment to be moved or made available, they must communicate this with the Studio owner prior to their rental time.
Renters are strictly prohibited from entering the prop closet, drawers, or cabinets. Any unauthorized access to these areas is a violation of this Agreement.

11. UNFAIR TRADE PRACTICES ACT

Maine's Unfair Trade Practices Act prohibits unconscionable or deceptive practices in contractual agreements. Ensuring that all terms are clear, fair, and mutually agreed upon can help in upholding the contract's enforceability.

By signing below, the Renter acknowledges that they have read, understood, and agreed to all terms of this Agreement.
